Thirty-six year-old Lennox De Nobrega was yesterday freed of a charge of causing death by dangerous driving after making an appearance before Chief Magistrate Ann McLennan in the Georgetown Magistrates’ Courts.
De Nobrega , of Church Street, Cummingsburg, Georgetown, was accused of driving motorcar PRR 7624 in a manner dangerous to the public on October 14, 2017, causing the death of 17-year-old Jhamallie Miles.
De Nobrega, who was represented by Attorney-at-Law Dexter Todd, pleaded not guilty to the charge.
He had been released on $500,000 bail pending trial.
Police said that the teenager, who was also a mechanic, was struck down at around 20:40hrs, while he was attempting to cross over Nelson Mandela Avenue, Georgetown. According to reports, De Nobrega was driving the motorcar which was proceeding west along Mandela Avenue when he collided with Miles, who suddenly dashed across the road. The injured teen was rushed to the Georgetown Public Hospital where he was pronounced dead on arrival. His cause of death was given as haemorrhage as a result of blunt trauma to the head.
Delivering her ruling in the matter yesterday, the Chief Magistrate summed up the facts and evidence led by the prosecution. According to the Chief Magistrate, no evidence was led by the prosecution to support that De Nobrega was driving in a dangerous manner on the day in question. She said that she believed the story narrated to the court by an eyewitness who recounted that Miles ran into the path of the motorcar.
The eyewitness’ story, the Chief Magistrate said, corroborated that of De Nobrega.
Further, the Chief Magistrate pointed out that although photographs of the accident scene were tendered during the trial, there was no evidence of skid mark impressions to support that the driver was indeed speeding.
After reviewing the evidence, the Chief Magistrate asserted that the court believed that Miles ran into the vehicle. “It was the deceased’s (Miles) actions that resulted in his death,” the Chief Magistrate noted.
As a result, the charge was dismissed against De Nobrega.
