Dear Editor,
In Kaieteur News (Tuesday, 30th January, 2018) you published yet a third story headlined “Ogle Airport granted 25-yr lease, but subleases to companies for 50 years”, targeting the Airport. Your newspaper, once again, claiming from unnamed sources, amongst other inaccuracies, that Ogle Airport Inc. has “illegally subleased lands to at least three companies”, naming JAGS Aviation, Hopkinson Mining and Air Services Limited.
In Kaieteur News (31st January, 2018), you published yet another distorted report by your reporter who was granted an interview by the Airport.
We, therefore, write in response to her report headlined “50-Year Lease granted by Ogle Airport not yet approved by Lands and Surveys – But Jags Aviation goes forward with development”.
Your reporter, while reporting that OAI addressed the matter of lands being subleased for 50 years when the Master Lease covers a term of 25-Years, unfortunately chose to omit a substantial part of the interview.
Your reporter omitted to report that she was referred to Article 19:3 of the Lease Agreement for the Management, Operation and Development of Ogle Aerodrome between the Cooperative Republic of Guyana and Ogle Airport Incorporated of November 5, 2001, which clearly states that the Airport operator will be permitted to remain in possession of the Airport for a period of seventy-five (75) years from the “Commencement Date” which is January 1, 2004.
Your reporter did not disclose that she was shown the documents establishing that the Airport’s Lawyers and the Lawyers representing the Lessees had agreed and signed on to Sub-lease Agreements based on the Airport’s power of renewal as provided by the November 5, 2001 Contract, in order to provide greater security to the Lessees.
Your reporter seemed not to have understood the fact that the Sub-lease Agreement she was shown, in the case of JAGS Aviation, gives the company a maximum lease period of 50-years with the proviso that the period of the Lease is for ten (10) years until 2028, subject to the renewal of the existing Master Lease for a lease period of fifty (50) years.
Your reporter was further told that OAI, on the advice of the Lands & Surveys Commission, has applied for an extension to its Master Lease (which the Airport is entitled to do) for a period of 50-years so that the security requested by our Lessees would be fully covered.
Of further significance, your reporter omitted to report that she was told that OAI has been written to by the Lands & Surveys Commission advising that the Commission is currently processing the renewal of the said Master Lease for a period of fifty (50) years, directing that OAI hold on issuing any further Sub-lease Agreements until the Master Lease is re-issued.
Ogle Airport Inc., therefore, wishes to make it absolutely clear that the contract between OAI and JAGS Aviation is legally valid and that OAI has the authority and has given JAGS Aviation the authority to commence the development of the land allocated to them.
With regard to the newspaper’s attempt to impugn the good name and reputation of OAI’s Chairman, Michael Correia, it was made clear to your reporter that Mr. Correia holds a minority interest in Trans Guyana Airways, Correia Mining Company and Caribbean Aviation Maintenance Services Limited, owned by the Correia Group of Companies, in similar circumstances to several other operators and is normal in business.
Kaieteur News’s accusation in its reporting of “incestuous relations” is malicious, unfounded and untruthful.
