A 39-year-old man who told the court that he had 38 grams of marijuana in his possession, which he had purchased and was on his way to give his nephew who is sick, was yesterday sentenced to three years imprisonment and fined $57,000.
Kenneth Bovell of Lot 2 Block E Sophia, Georgetown, appeared before Chief Magistrate Ann McLennan in the Georgetown Magistrates’ Courts and pleaded guilty to the charge, which stated that on November 1 at Lamaha Gardens, Georgetown, he had in his possession 38 grams of marijuana for the purpose of trafficking.
Facts presented by Police Prosecutor Arvin Moore stated that on the day in question, at about 18:05 hrs, Police, while on an exercise, conducted a search on the accused in the vicinity of Lamaha Gardens.
The court heard that the accused had a black bag with a quantity of leaves, seeds and stems of cannabis. The accused was then cautioned and he admitted that the marijuana belonged to him.
The accused when given a chance to address the court said “My nephew does trouble from asthma and his mother does give me money to buy the marijuana to give him, because that’s the only thing that does work for him. It’s for medical purposes.”
The magistrate sentenced the defendant to three years based on the fact that he pleaded guilty on his first appearance and did not waste the court’s time.
