Dear Editor,
With due respect, the CJ erred in granting more time to GBTI to find missing documents. Had the Chief Justice (CJ) invoked the penal clause of the Anti-Money Laundering & Counter Financing of Terrorism Act that is linked with a breach of an order of the court, millions would have been delivered into the public purse by GBTI.
And the CJ could have still ordered GBTI to deliver all outstanding documents to SOCU. She granted the production order yet she did not uphold her own order. What does this say for orders given by the courts moving forward?
The CJ’s decision also has implications for the contempt charges the GBTI Directors should answer to this coming week. Another opportunity lost to show that breaches of the law will not be tolerated no matter who you are.
Will a further 3 weeks guarantee that GBTI will hand over to SOCU authentic documents that the GBTI have been unable to turn over within the original time frame stipulated by the Courts? I think not. The ordinary man in the street and silent majority understands what is playing out here and is watching with seething anger.
