“I am not going to send you to jail. Jail is not going to help you,” said Senior Magistrate Fabayo Azore to 18-year-old Mawali Clarke before sending him to undergo counseling for narcotics and substance abuse.
Last month, Clarke, of Lot 564 Section D, Turkeyen, Greater Georgetown, had appeared before Magistrate Azore, and pleaded guilty to two counts of robbery under-arms.
He admitted that on July 6, at North Road, Bourda, Georgetown, while armed with a knife, he robbed Joelle Ramsarran of a Samsung Galaxy S4 cellular phone valued $45,000.
Clarke further admitted that on the same day, while armed with a knife, he robbed Sally Khan of a Samsung Galaxy S5 cellular phone valued $120,000.
According to Police Prosecutor Simone Payne, on the day in question Khan and Ramsarran were walking through a passageway in the compound of Game Express when they were accosted by Clarke, who was armed with a knife. Clarke demanded that the women hand over their valuables, and they gave him their cellular phones. Clarke was caught on CCTV robbing the women and also admitted to the offences in a caution statement given to police.
Clarke had told the Magistrate that he committed the robberies while he was “high” as a result of smoking marijuana. He had disclosed that he was hungry at the time and promised that he would never rob anyone again.
Magistrate Azore had deferred sentencing for Clarke until Wednesday pending a probation report.
In the probation report it was highlighted that Clarke was raised by his mother since his father died.
The Social Worker said that although his mother tried her best to take care of him, she lacked the necessary parental skills to supervise him.
According to the probation report, Clarke has been given numerous opportunities to do well with his life, but insists on doing otherwise.
Clarke in his address to the court insisted that he only does bad things when he is under the influence of alcohol and marijuana. Nevertheless, the Magistrate imposed a $25,000 fine on each of the charges with a default imprisonment of six months. Clarke has to meet with a probation officer twice monthly for the next six months.
