Twenty-seven-year-old Oswald Wayne was yesterday remanded to prison after he appeared before Senior Magistrate Leron Daly in the Georgetown Magistrates’ Courts.
The defendant denied the charge which alleged that on July 31 at Water Street, Georgetown, he unlawfully and maliciously assaulted Shawn Sam, so as to cause him actual bodily harm.
It was further alleged that on the same day in question, he walked behind Arlene Leacock, breaching a protection order that was instituted by Magistrate Annette Singh.
When given a chance to address the court, the defendant said “Me and the man (Sam) had a fight and when he child mother (Arlene Leacock) come to part the fight…after the fight she went and tell the police that I walked behind her.”
Police Prosecutor Sanj Singh objected to bail being granted to the defendant, citing that he was ordered not to go within 50 yards of Arlene Leacock, but he did.
Based on what the prosecutor said, the magistrate told the court that the protection order was put in place to protect the victim and he (Wayne) had breached the order. For that reason the defendant was remanded to prison.
Meanwhile in the same court, Shawn Sam denied the charge which alleged that on July 20, at Stabroek Market, he unlawfully and maliciously inflicted grievous bodily harm on Oswald Wayne.
The defendant said “On the day in question about 10:00hrs I was in the Stabroek Market where I conduct business. “My child mother came to me and told me that Shawn cuff her in her face. I went to Shawn and asked him why he cuff my child mother in her face, and that is when he took a bench and hit me in my face with it.”
Police Prosecutor Sanj Singh had no objections to bail being granted to Sam, but asked that it be in a substantial amount.
Senior Magistrate Leron Daly then granted bail to Shawn Sam in the sum of $80,000. Both men will make their next court appearance on August 11.
