Investigations into alleged larceny committed by former Attorney General Anil Nandlall in relation to 15 Law Reports are still ongoing, says Special Prosecutor Patrice Henry. When the matter came up yesterday before Magistrate Fabayo Azore, Prosecutor Henry told the court that he is confident that investigations will be completed by May 26. He requested a date to report on whether the matter will be tried indictably or whether the administration of justice act will be applied.
Should the court proceed indictably a preliminary inquiry will be conducted and if a prima face case is made out the matter will be sent to the High Court for trial.
However, if the Administration of Justice act is applied the matter will go to trial before Magistrate Azore.
Attorney Sanjeev Datadin questioned the basis on which Nandlall is being charged since investigations are still incomplete. The attorney asked that the charge be dismissed and that when the prosecutor has everything ready he can reinstitute the charge. The lawyer is further contending that his client’s rights under Article 144 are being violated.
“Nandlall is hanging under a charge while the state is seeking to obtain evidence,” Datadin argued.
He added that the failure of the prosecution to serve statements on his client is depriving him of all things to allow him to defend himself.
This matter continues on May 29 for report.
Nandlall was charged last month for the alleged theft of the Lexis Nexis Law Reports of the Commonwealth that cost some $2M. The law reports are the property of the Ministry of Legal Affairs, the charge contends.
The High Court has since restrained the Special Organized Crime Unit from seizing the law reports.
