On March 8, two NIS inspectors – one male, one female – went to the office of a young lawyer who is a rising figure in the PPP to inquiry about his NIS payment for him and his staff. The two inspectors said there were abused by the lawyer. The allegation is that he used a scatological vocabulary to chase them out of his office.
One exclamation went like this; “Get out of my f…ing office; y’all is a pack of dunces.”
The matter was reported to the management of NIS and a complainant was lodged with the Brickdam police station. Yesterday, I spoke to Senior Superintendent Brutus of Brickdam. He said that there was no movement on the inspectors’ complaint because the police were unable to secure the presence of the lawyer until last Thursday.
The police have a term they use that when I first heard it, I thought of its literal, grammatical connotation. It is called, “confrontation.” But it does not mean confrontation in the mainstream way as we know it. What this police term means is that when a citizen makes an allegation that involves a criminal violation, the nature of the allegation is put to the accused in the presence of the accuser and the police analyze the contents of the exchange. Superintendent Brutus told me that the confrontation was held and there will be one of two outcomes. If the police are satisfied that there is evidence to support the inspectors’ accusations, the lawyer will be charged. If the police have doubt, the file will be forwarded to the DPP.
This lawyer holds a constitutional office that is beyond the jurisdiction of the President. In case you don’t know, there are some occupations like that. The President cannot dismiss or terminate the contract of the Director of Public Prosecutions. If the State wants to remove the DPP then certain proceedings will have to be initiated. One recalls the case of Justice Barnwell and President Desmond Hoyte. Mr. Hoyte had to go through a long route to get the removal of the judge and that could only be done through a tribunal. In this case of the lawyer, I think his tenure is submerged in concrete.
I grew up hearing my parents often use the expression, “pick sense out of nonsense.” It was their way of saying what the academic normally put as, “let’s do logical deduction.” Well, let’s do logical deduction or “pick sense out of nonsense.” NIS inspectors face hostility all the time. People normally show serious vexations at their visits. But why in this case of the PPP lawyer, they would report him to the police station? I would go so far as to say that for them to do that, then they were seriously abused.
It strains the imagination to think the two inspectors were just shouted down and they went to the police. NO! I think they were treated very roughly. I spoke to the lawyer’s attorney but did not contact him. I chose not to do so because I know he would have called Kaieteur News and warned them about publication because he will sue for libel. Three lawyers who are very well learned civil attorneys said that once I do not name him, there is no reason why I cannot write about the incident.
If the police do not charge, the episode is still important for the Guyanese people to reflect on. The lawyer, even if he did not abuse or threaten the inspectors, his arrogance shows he has no respect for them. But he should. They are important state officials doing state functions that are crucial in any society.
NIS inspectors, GRA tax inspectors, court marshals, food and meat examiners are not people you chase away. You cannot do that and should not be allowed to do it. It is a criminal offence and if there is evidence of assault then the police should charge.
This society has been broken a long time ago. When you think of who this lawyer is, yet he could display such conduct to two NIS inspectors, what he wouldn’t do to the garbage collectors or cane cutters. Of course he is just another person who has no respect for the country, its laws, mores, customs and ethics.
If Guyanese know who the person is that took those faked statements of poll into GECOM during the 2015 elections, they would faint. People with those statuses do not do such things. But they do it in tenth rate banana republics. Guyana is worse than that.
