Colleen Kendall of Penny Lane, South Ruimveldt Gardens, Georgetown has been released on $5,000 bail. The 57-year-old woman made an appearance before Chief Magistrate Ann McLennan yesterday and pleaded guilty to a charge of fraudulent conversion.
It is alleged that between September 1, 2016 and January 5, 2017, at Georgetown, Kendall, being solely entrusted by Angela Venkatsammy with a quantity of household articles to the value of $223,817, in order to sell and return the proceeds to the said Venkatsammy, fraudulently converted same to her own use and benefit.
However, after admitting to the crime, Kendall offered to repay the virtual complainant (VC) and was given time to do so by the Chief Magistrate. Yesterday in court, Kendall handed over $20,000, which she claimed was the only monies she had, to Venkatsammy. The Chief Magistrate ordered her to pay the VC at least $50,000 or more on January 30, when she will make another court appearance.
According to Police Prosecutor Deniro Jones, the parties are known to each other. Jones said that the VC owns a store at the Brassonic’s building, Water Street, Georgetown, and that the defendant would from time to time take items from her to sell.
Jones said that Kendall took the items to the value mentioned in the charge, to sell and agreed to return the proceeds to the woman. However, he pointed out that efforts made by the VC to contact Kendall after the transaction were futile.
Prosecutor Jones added that Venkatsammy reported the matter to police and the defendant was arrested and charged.
When asked by the Magistrate as to why she failed to pay the woman, Kendall explained that she was experiencing some financial difficulties at the time. She admitted that she would purchase stocks from the VC to sell at her store. However, she said, she was forced to close down the business because she was not making enough money to pay rent.
Kendall revealed that she still had some of the household items in her possession and was advised by the Chief Magistrate to sell them off to get back money to pay the VC.
The defendant told the court that she is presently unemployed and is now being forced to sell her home.
It was then that the Chief Magistrate advised her to look for a job or sell her assets to get money to pay Venkatsammy.
