A 17-year-old schoolboy and a taxi driver, who were allegedly found by police with an illegal shotgun in a car, were yesterday released on bail after they appeared before Magistrate Leron Daly at the Georgetown Magistrates’ Courts.
Dion Chan, a 29-year-old taxi driver of 60 Remus Street, Agricola, East Bank Demerara, and the teenager, also an Agricola resident, are accused of having a shotgun in their possession on August 25, at Golden Grove, East Bank Demerara, when they were not the holders of valid firearm licences. Chan was represented by Attorney Adrian Thompson. The teen had no legal representation.
The 17-year-old was granted bail to the tune of $150,000.Chan is on $250,000 bail.
Thompson requested for his client to be released on bail citing multiple occupancy. The lawyer told the court that on the day in question, Chan was transporting several passengers to Golden Grove whom he had picked up from the Stabroek car park.
Thompson said that when his client arrived at the location the passengers disembarked the car and requested for his client to wait. However, Thompson added that police later intercepted the vehicle and carried out a search on it and allegedly found the gun in the trunk of the vehicle concealed in a black bag. Thompson pointed out that upon seeing the police, the passengers made good their escape.
“The fact that the passengers escaped meant that they knew what was in the bag,” the lawyer said.
In addition, the lawyer told the court that Chan has denied knowledge of the firearm and was even placed on an identification (ID) parade and was not positively identified. He further told the court that at the time the car was searched, his client was acting in the course of his duties.
Thompson also related that ballistic and fingerprint analysis was done on the shotgun and his client’s fingerprints were not a match.
Police Prosecutor Shevon Jupiter had no objections to the defendant being released on bail. However, she related that she is still awaiting the ballistic report for the firearm, thus questioning where the lawyer received information about the ballistic analysis on the weapon.
Jupiter indicated that investigations are still ongoing in the matter and asked that conditions be attached to the defendants’ bail.
Jupiter requested for the teenager and Chan to lodge their passports and report to the Criminal Investigations Department (CID) Headquarters, Eve Leary, Georgetown.
Magistrate Daly upheld the prosecutor’s requests and instructed the defendants to return to court on September 9, when they will appear before Chief Magistrate Ann McLennan.
