Attorney Ronald Burch-Smith is contending that his client, Robert Benn did not intend or premeditate to kill 24-year-old Colin Perreira, who had turned a car on his bridge in front of his Perry Street, Tucville, Georgetown home, last week Tuesday.
Benn, who is a businessman and licenced firearm holder was remanded to prison yesterday after he was arraigned before Magistrate Leron Daly, accused of murdering Perreira called ‘Malcolm’ of 213 Barr Street, Kitty, Georgetown. He was also accused of discharging a loaded firearm at Gail Ann Chacon, 22, with intent to murder her.
Benn was not required to plead to the indictable offences when he appeared in the Georgetown Magistrates’ Courts.
During his address to the court, Burch-Smith questioned Police Prosecutor Shevon Jupiter as to why his client was being charged with the capital offence of murder instead of manslaughter. The lawyer pointed out that the killing was not deliberate or premeditated.
Burch-Smith argued that Benn was living in fear, since several threats had been made on his life. According to the Attorney, persons had threatened to attack, kill and rob his client.
In addition, the court was told by the Attorney that Benn felt afraid when he saw the car turning on his bridge because he believed that the occupants of the vehicle were bandits.
Police Prosecutor Shevon Jupiter related that investigations are still ongoing in the matter. She also indicated that Chacon is still hospitalized.
The matter will be re-called on September, 16.
The police have said they were investigating the alleged murder of Perreira and attempted murder of Chacon by the licenced firearm holder which occurred around 21:30hrs on the day in question.
According to reports, Perreira, who was driving a heavily-tinted motorcar, with Chacon seated in front, attempted to turn around the vehicle, in front of Benn’s residence. In the process, Benn, who was reportedly in his yard, whipped out his licenced handgun and discharged several rounds at the vehicle, hitting the victims about their bodies.
