I read Freddie Kissoon’s column where he stated that he was afraid to return to give evidence in the current matter before the court. I would like to tell Freddie Kissoon to keep his chin up; he is doing the right thing as he moves forward to seek justice. First, as a seasoned magistrate Ms. Latchman it appears have a problem running her courtroom; if a witness tells her he/she does not understand a question it is her duty to ask the lawyer to rephrase the question to the witness for better understanding. If there is a problem with grammatical presentation from a lawyer to a witness, it can be easily misinterpreted and the wrong response can cause a problem in the outcome of a case. Freddie KIssoon is right, the magistrate is obligated to ask the lawyer for clarification as to what indiscretion was committed by the witness, and if there was one, then advise the witness as such, or inform the lawyer that there was none.
Mr. Hanoman advising the magistrate to address Freddie Kissoon’s demeanour and that it should have a bearing on the outcome of the case, was just a ploy to influence the magistrate. Who among us would not be upset to relive a horrible incident? Kissoon should know Hanoman probably reads his columns and knows the capability of his mental faculty, so when he asks the magistrate to rule that Kissoon was mentally incompetent, it was in jest. He is doing his very best as a lawyer representing his client and will throw the kitchen sink at Kissoon if he can. Let’s understand the important aspect of this case, KISSOON IS NOT A WITNESS, HE IS A VICTIM.
