Justice Jo Ann Barlow sitting in the Berbice High Court on Monday issued an arrest warrant for murder accused Raymond Pestano, 38, who with his father, Roy Pestano Sr, 68, are accused of murder committed back in 2002.
Roy Pestano Sr. and his son Raymond Pestano of No. 41 Village, West Coast Berbice, are accused of murdering fellow villager, Davanand Ramlagan, 25, on October 19, 2002.
The incident is alleged to have been committed at the Breezy Point shop, No. 41 Village, West Coast Berbice.
The men are on bail. The father and son have so far undergone two High Court trials which have both ended in hung Juries and two Preliminary Inquiries.
After the second High Court hearing, the men through their Attorney Peter Hugh petitioned for bail which was granted in the sum of $450,000 each by Chief Justice Ian Chang.
The matter was scheduled to begin in the Berbice High Court, however Raymond Pestano was absent. The Judge thus issued the warrant for his arrest.
The prosecution’s case was that around 21.30 pm, Davenanand Ramlagan and his cousin, Goel Ross, were at the Breezy Point shop in No. 41 Village when the two accused along with Roy Pestano Jr. drove up in a car. An altercation took place and Ramlagan was injured and left lying in a pool of blood.
A post mortem examination conducted by Government Pathologist Dr. Nehaul Singh had concluded that there were four wounds on the body, two stab and two slash incisions, while the throat was almost severed.
After the incident Roy Pestano Sr. and his sons, Raymond and Roy Pestano Jr. were arrested and charged with the capital offence. During the first Preliminary Inquiry the matter was discharged.
However the men were ordered re-arrested, and a new Preliminary Inquiry was held. By then Roy Pestano Jr. had fled the jurisdiction. They were committed to stand trial in December 2011.
They were first tried in the High Court in September 2013 and the Jury failed to reach a verdict.
