Dear Editor.
Allow me to respond to former AG Nandall’s letter to Kaieteurnews date 06-26-2016, captioned “Response to Freddie”.
Nandlall has the audacity to assault the intelligence of the readers of Kaieteur News with his deplorable explanation, and excuse, as to why his conversation with reporter Gildarie did not amount to a threat. First, his then government in power attempted to mislead the citizens of this country by saying the taped conversation was a hoax in an effort to sway
public opinion and garner support, in an attempt to make Nandlall out as the poor victim, which was an embarassment for the conspirators.
Mr. Nandlall abused his then position and that of his office by indirectly making threats against Kaieteur newspaper and that of its employees. I saw where it stated in “Laws Of Guyana” Page 34, Section 41, That everyone who, without lawful excuse utters, or directly or indirectly causes to be received, any threat of murder, or to kill, or to causes grievous bodily harm, or to shoot at, any person, is guilty of a felony and is liable to ten years in prison.
The English dictionary stated that “utters” means “to give audible expression” “to say something” “to make sound with your voice”. The Law states that a person can be arrested and prosecuted as an accessory before a crime is committed, or after a crime is committed. The law also states that a person can be arrested for directly or indirectly making threats.
Nandlall admits to the conversation after there were no escape routes available, typical of an animal that cannot shake loose the hungry ticks, he comes up with various analogies as excuses. He writes, “If I say to someone that if you don’t look before you cross the road you will be struck down by traffic”, that it is not a threat. Everyone knows it is
not a threat. Nandlall cannot wiggle his way out with his poor comparison. To invoke the name of his grandmother who I
am positive if she is still alive, would distance herself from him after hearing his unscholarly and unadulterated rant. I am positive she taught him better. He further stated in his response to Kissoon “Can lawyers be accused of threatening their clients? Of course not”. That information is incorrect. If I am a lawyer and I tell my client “ You better have the money to pay me after I represent you, or else you will be dead”, is a threat.
Anyone listening to the conversation clearly understands that Nandlall was very upset, but that is not an excuse to indirectly make threats, especially from a so called learned professional and sitting AG.
He told Gildarie that people were going to walk into the Saffon street office with their weapons and what is going to happen will happen, Peter will pay for Paul, and honestly it will happen soon. So the quicker Gildarie gets out, will be for the better, meaning that he can save himself, or else he too will get the same medicine meant for the others.
He states that Mr. Lall is aware of his (AG) capacity, he does not have to revert to the courts, he can revert to other methods, more effective methods (read between the lines- indirect threats). He tells Gildarie that Kaieteur News is a dangerous place to work, and to read between the lines, it was going to happen soon. He states “if this thing go down this road, it’s not going to be good, the tempo has changed, people get sensitive now” He says that he is of a higher breed (Chatree) that he is not Jagdeo, or Bobby or Brassington. It appears Nandlall believes that readers of Kaieteur News just stepped off the banana boat.
Mr. Editor, Nandlall had one and only one intention that day when he made that phone call, and that was to intimidate Lall and his employees, by issuing these indirect threats. He wanted to instill fear and that he did. Readers will never forget the past murders of Kaieteur News employees. He is well aware of that (from his own mouth “read between the lines”).
This matter cries out for justice, and like my Guyanese compatriots, we call on Attorney General Basil Williams to reopen this case, and let justice take its course. In a democratic country Nandlall would be facing prosecution. Can this government please do the right thing.
