Hansel Andre Lewis, called “Smiley” “Hansel” and “Andre”, was found guilty of attempted murder committed on New Year’s morning, 2013 in New Amsterdam, Berbice.
He was on trial in the Berbice High Court.
Lewis, 38, of 479 John Lewis Street, Angoy’s Avenue, New Amsterdam, Berbice, was on trial before Justice Brassington Reynolds and a mixed Jury. He was charged with attempting to murder Chris Borrowes on New Year’s Day 2013 at Republic Road, New Amsterdam.
He was also charged with wounding with intent to cause grievous bodily harm or to maim, disfigure or disable Burrowes.
Prosecutor, Attorney at law Stacey Goodings, told the court that on New Year’s Day 2013 at Republic Road New Amsterdam, Lewis wounded Chris Burrowes, 41, called “Bully” of Alexander Street; New Amsterdam.
The assailant slashed the man’s throat following an altercation. The victim was rushed to the New Amsterdam Hospital and taken to the ICU where doctors’ performed emergency surgery on him. Lewis, a deportee from the USA, went home. He was subsequently arrested for the crime and charged. Attorney-at-Law Ramesh Rajkumar is appearing for him.
Prosecutor Goodings called four witnesses among them policeman Ashook Latchimi Persaud.
Businessman Anthony Cadore, who operates the Rainbow Bar, stated that he had an Old Year’s Night activity at the bar. He said that around 6:45 hrs on New Year’s morning he had just exited the bar when he saw “Smiley” and “Bully” squaring off. The incident did not occur at his bar but a distance away. He subsequently saw Burrowes holding his neck.
The medical certificate prepared by Dr. Ally, recalled examining the victim in the hospital. There was an open wound which was caused by cutting or tearing. The injury had damaged the trachea and the esophagus. It resulted in temporary disability and caused a permanent scar.
Burrowes had told the court that he knew the accused for a number of years. He had recalled being in the vicinity of the Rainbow Bar where he had drank Banko and was standing on the road.
The accused who was smoking something had come and stood next to him. He upbraided the accused who told him he like to talk.
He had just finished urinating and was in the process of zipping up his pants when the accused pulled out a knife from his left side pocket and stabbed him on his neck. He mentioned that he had a good look at the accused. “There was nothing blocking me. I held on to my neck. It was bleeding and the accused calmly walked away.”
Burrowes stated that he subsequently went to his parents’ home not far away. He collapsed and was rushed to the New Amsterdam Hospital where he was admitted for emergency treatment.
Attorney at law Ramesh Rajkumar had put forward a no case submission. He had stated that it was a case of mistaken identity.
Prosecutor Stacy Goodings had relied on the evidence provided. She argued that there was no mistaken identity, the place was bright enough, the two men knew each other, and Burrowes had stated that he had a good look at the accused.
Justice Reynolds had directed the jury on the law after which they retired and returned about two hours after with the unanimous verdict of guilty.
Lewis is expected to be sentenced during the week after a probation report is presented.
