Family disputes are more than often held to be in a different class by themselves. Resolving such disputes demand systems sensitive to the peculiar and often complicated issues which may arise. Enabling the judiciary to deal with such matters, the long awaited Family Court was thereby established last Monday.
The formal opening of the court was delayed for some time due to amendments being made to the Family (Proceedings and Procedures) Rules (FPPR). Now that they have been finalized and approved they will govern the operations of the court as it relates to the types of matters it will hear and the steps that should be taken to arrive at the best decision for disputants.
The court will be presided over by two judges and will be located in the north-eastern block of the High Court compound, Georgetown. These rules will also be applied by Judges in the counties of Berbice and Essequibo at the New Amsterdam and Suddie High Courts respectively. The Family Court is equipped with its own Registry and a Children’s Waiting room.
To promote its mandate, the court will be working closely with the Child Care and Protection Agency (CCPA), especially in child welfare matters and also utilizing the services of the High Court’s Mediation Centre.
The court’s establishment has been credited to the assistance provided by the Government of Guyana, Minister of Social Protection Volda Lawrence, Child Care and Protection Agency Head Ann Greene and the Attorney-General Basil Williams. Additionally, Justice Robin Mohamed of the Trinidad and Tobago Judiciary along with United Nations Children’s Fund representative in Guyana, Marianne Fiach, played important roles in the preparation of the Family Rules.
