… injunction discharged
The Mayor and City Council (M&CC) was granted $40,000 in cost after the complainant who had caused a High Court Judge to lay an injunction against the Municipality, withdrew his case yesterday.
Last week, the vendor, who refused to be part of the city’s ongoing street vendor relocation initiative, approached the High Court to halt his removal from the Water Street location outside the Guyana Stores zinc bond. He claimed that the bond’s owner, businessman Malcolm Panday, had given vendors permission to operate in front of his property. The court granted the ex parte injunction.
However, Panday denied giving permission for vendors to occupy the perimeter of his bond and provided an affidavit to authorities attesting to this information.
When the matter was called at the High Court yesterday, the complainant withdrew his case and was ordered to pay costs.
Prior to this, the Council was also able to have the injunction discharged. This was after the attorney for City Hall, Roger Yearwood had presented the businessman’s affidavit to the court.
The Mayor and City Council says it is currently seeking an organized and healthy vending situation in the city and welcomes the participation of all stakeholders.
