A statement made by self-confessed hitman, Lennox ‘Two Colours’ Wayne, is yet to be produced to City Magistrate Alex Moore who is currently conducting an inquest into the deaths of two men who were shot by police.
The Director of Public Prosecution had ordered that an inquest be held into the deaths of Paul Bascom, former resident of Diamond Housing Scheme, and Alberto Grant, or Alberto Mustapha, 28, called ‘Mukie’, formerly of Lot 299 Meadow Brook Gardens.
The men were killed during a 20-minute shootout with police on December 7, 2013 at Diamond, East Bank Demerara.
When the matter came up on Thursday, Attorney Nigel Hughes, who is representing the interest of the police, told the court that he had contacted Crime Chief Wendell Blanhum in relation to the missing statement.
He said that Blanhum advised him to contact Head of Major Crimes Units, Assistant Superintendent of Police (ASP) Mitchell Caesar, for the document. Hughes said that he was assured by the ASP that the statement would be made available to the court.
Hughes has affirmed that Wayne is vital to the inquest because he was an eyewitness to this shooting and another police shootout which occurred on October 12, 2013 near the K&VC Hotel on South Road, Georgetown.
That second shooting, he said, claimed the lives of three Albouystown residents.
According to the lawyer, Wayne has expressed willingness to give a new statement.
Police Sergeant, Leon Lindo, who was among the party of police that were involved in the shoot-out at a previous court hearing, had sought to explain the reason for the statement being missing from the file.
He had told the court that the file was prepared in 2013, while Wayne’s statement was only given last year. He said that the statement is somewhere at the Criminal Investigation Department (CID).
It was at this hearing that the Magistrate, while browsing the file discovered that Wayne’s statement was not there.
He had ordered that the statement be located so that this witness could testify. Wayne is currently on remand for the murder of a Lusignan, East Coast Demerara cosmetologist.
Wayne has refuted the police versions of what transpired on the night of the Diamond shooting.
The police had reported that their ranks had staked out the home of a trucking service operator at Diamond, East Bank Demerara, which the men were reportedly planning to rob.
According to the police, they challenged two men who were approaching on foot, and one of them pulled out a handgun and opened fire on the ranks.
The police returned fire and fatally wounded both men. The police said that they recovered a .38 snub-nose revolver with two live rounds and two spent shells, along with one 9mm. round and two 7.62 x 39 rounds.
Police Lance Corporal, Albert Mendonza who is now stationed at the Whim Police Station testified yesterday. He assisted with investigation into the Diamond fatal shootings.
This inquest has been adjourned until April 29, for reports.
