The murder trial of Calvin Bailey ended in yet another hung jury, after a mixed jury, following hours of deliberation, failed to return a unanimous verdict at the High Court in Georgetown yesterday. Bailey was charged for killing 18-month-old Shaquan Nero.
He was accused of chopping the toddler to the throat, during an altercation with the baby’s mother Bernadette Nero in April 2007. Bailey, called ‘Lava’, of Wisroc Housing Scheme, Linden; Agricola, East Bank Demerara and Campbellville, Georgetown, faced a trial before Justice Priya Sewnarine-Beharry and a 12-member jury.
The case was presented by State Prosecutors Michael Shahoud and Orinthia Schmidt. Bailey was represented by Attorney Peter Hugh.
Although potentially cleared of the murder charge Bailey was however sent back to prison since he has another case pending.
This is the second trial before a Judge and Jury for the accused. He had faced trials for the offence in 2013 and 2014.
Both ended in hung jury verdicts.
In his defence, Bailey gave an unsworn statement in which he told the court that it was in fact the child’s mother, who chopped the baby during the altercation. He claimed that the woman was leaving him and taking their son to Georgetown with her but he could not allow her to do so, since he shared a special bond with his son.
But the child’s mother, who currently resides in Barbados, gave a different account of the incident. She recalled a brutal attack perpetrated by former spouse. The woman recalled on April 5, 2007 she was at her aunt’s residence at Cinderella City, Linden when Bailey came looking for her; she had decided to leave after the relationship became abusive.
She recounted that he had attacked her and during that incident he had chopped the infant.
