Magistrate Zamilla Ally–Seepaul, who is presiding over the trial of the five men accused of robbing land
court judge Nicola Pierre, will tomorrow make a ruling in relation to all alleged oral and caution statements given by the defendants.
The Magistrate indicated this to the court yesterday, after Police Constable Chesney wrapped up evidence in the voir dire (trial within a trial).
The voir dire was ordered after robbery accused Damien Millington denied that he gave police an oral statement in relation to the crime. As it pertains to a caution statement, he is alleging that he was forced to sign the document.
The voir dire will determine whether or not the oral and caution statement can be admitted as evidence in the trial.
Premnauth Samaroo, Damien Millington, Nicholas Narine, Anthony David and Warren Mc Kenzie, are jointly facing three charges – two for robbery under-arms committed on Pierre and her husband, Mohamed Chand and another for the offence of discharging a loaded firearm at security guard, Ron Peters.
They have all pleaded not guilty to the charges and are currently on remand.
Apart from the alleged statements given by Millington, the Magistrate is expected to rule on two oral statements given by Warren McKenzie.
Special Prosecutor Nigel Hughes had led evidence that McKenzie uttered to police “Is wha I put meself in here boy…if I know that lady was a judge they coulda neva get me on that wuk”, when allegations of robbery under-arms committed on the judge and her husband Mohamed Chand were put to him at the Brickdam Police Station.
The prosecutor’s evidence had also alleged that McKenzie told Police, “Is not me….meh nah had no gun pun that wuk”, after an allegation of discharging a loading firearm at security guard, Ron Peters was put to him, also at the aforementioned Police Station.
Millington has denied making such statements to police.
Four Police witnesses were called to testify during the Voir Dire.
