Three police witnesses testified yesterday, as the voir dire into the admissibility of an oral and caution
statement alleged to have been given by Damien Millington continued in the Sparendaam Magistrate’s Court.
Special Prosecutor, Nigel Hughes, questioned Sergeant Flats, Sergeant Adams and Constable Caleb in relation to a testimony given by Millington (the number two defendant) at the commencement of the Voir Dire (trial within a trial) last week.
They all refuted allegations made against them by Millington.
After the witnesses completed their evidence, Prosecutor Hughes declined to cross examine. While Damien declined to cross examine Sergeant Flats, and Sergeant Adams, he grilled Constable Caleb.
However, Constable Caleb was called by Millington as a witness. Millington identified the Constable as one of the officers who took him to the Georgetown Public Hospital Corporation (GPHC) for medical attention. The trial was adjourned until Friday when another police witness will take the stand.
Premnauth Samaroo; Damien Millington, 22, of Lot 118 Caesar Street, Agricola, Nicholas Narine, 18, also of Caesar Street Agricola; Anthony David, 28, of 63 Hadfield Street, Stabroek and Warren Mc Kenzie, 22, of Lot 18 Brutus Street, Agricola, are jointly facing three charges, two for the offence of robbery under-arms committed on Pierre and her husband and another for the offence of discharging a loaded firearm at security guard, Ron Peters.
They have all pleaded not guilty to the charges and are currently on remand.
The Voir Dire trial was ordered after Millington denied that he gave police an oral statement in relation to the crime. As it pertains to the caution statement, he told the court that he was forced to sign the document.
So far, the prosecution has concluded its case. Several Police and civilian witnesses were called to testify. Among those were the land court judge and her husband Mohamed Chand. Also testifying was the couple’s security guard Ron Peters.
They have, so far, positively identified four of the defendants (Samaroo, Millington, Narine and McKenzie) as the ones who were part of the robbery/home invasion that occurred on July 9, last in the gated community of Felicity, East Coast Demerara.
