Damien Millington, one of the five men accused of carrying out a robbery at the home of Land Court Judge
Nicola Pierre, last year, gave an unsworn testimony yesterday, when the court commenced a Voir Dire as the matter continued at the Better Hope Community Centre.
The Sparendaam Magistrate’s Court is now temporarily housed there.
The Voir Dire (trial within a trial) was ordered by Magistrate Zamilla Ally-Seepaul after Millington denied that he had confessed to the crime in evidence led by Special Prosecutor, Nigel Hughes.
This trial is being done to ascertain whether the oral confession and written statement alleged to have been obtained from him were willingly or involuntarily given. It will also determine if they can be admitted as evidence in the trial.
Magistrate Ally-Seepaul guided him as he related his story to the court because he had no Attorney. He declined to call witnesses to support his case.
Thereafter, the matter was adjourned until Monday 29, when Prosecutor Hughes will present his arguments. When this is completed the Magistrate will make her ruling on the admissibility of the alleged oral confession and caution statement.
Millington had told police at the Criminal Investigation Department (CID) Eve Leary that he was wrongly identified on an identification (ID) parade. This was according to evidence led by Prosecution witness, Police Corporal Munilall Persaud. At a previous court hearing, he had claimed that he was forced to sign the caution statement.
Damien Millington, 22, of Lot 118 Caesar Street, Agricola Premnauth Samaroo; Nicholas Narine, 18, also of Caesar Street Agricola; Anthony David, 28 of 63 Hadfield Street, Stabroek and Warren Mc Kenzie, 22 of Lot 18 Brutus Street, Agricola are jointly facing three charges, two for the offence of robbery under-arms committed on Pierre and her husband and another for the offence of discharging a loaded firearm at security guard, Ron Peters.
They have all pleaded not guilty to the charges and are currently on remand. The trial of the five men began on January 11. So far, the prosecution has concluded its case.
Several police and civilian witnesses testified. Among those were the Land Court Judge and her husband Mohamed Chand. Also testifying was the couple’s security guard Ron Peters.
They have so far, positively identified four of the defendants (Samaroo, Millington, Narine and McKenzie) as the ones who were part of the robbery/home invasion that occurred on July 9, last in the gated community of Felicity, East Coast Demerara.
