-freed after claiming self defence
A West Ruimveldt man, who hurled several bottles at his friend, after the man attacked him with a cutlass over some broken louvre windows, was yesterday freed on a wounding charge by Chief Magistrate Ann McLennan.
The two friends were yesterday arraigned in the Georgetown Magistrates’ Courts.
The men, Kurt Cliffe, 26, of West Ruimveldt, Georgetown and Osafo O’Neil, a 37 year-old taxi driver, of Lot 317 West Ruimveldt, were both charged with unlawfully and maliciously inflicting grievous bodily harm upon each other on January 13.
Cliffe pleaded guilty with explanation to the charge, while O’Neil pleaded not guilty.
However, after Cliffe explained to the Magistrate that he was acting in self defence, he was reprimanded and discharged. O’Neil was however, placed on $10,000 bail and ordered to return to court on January 29, before Magistrate Alex Moore.
Cliffe explained that he and the complainant (O’Neil) were involved in a confrontation. He added that man later armed himself with a cutlass and attacked him. He stated that he was forced to defend himself and in the process tossed several bottles at O’Neil.
Cliffe showed remorse to the court and told the Magistrate that his actions were not intentional and he was not looking for a problem.
Police Prosecutor, Corporal Deniro Jones in relating the facts of the matter, told the court that on the date in question, O’Neil was playing football in the neighbourhood when he kicked the ball into the victim’s windows and broke them.
Jones related that a confrontation was held between the two men and Cliffe picked up several bottles and pelted the man.
He stated that the victim was taken to the Georgetown Public Hospital Corporation (GPHC), where a medical report was prepared. According to the Prosecutor, the victim in this matter received lacerations to the left temple and three of his left fingers.
