A detective corporal attached to one of the station in Essequibo presumptuously violated the law by coercing a young woman to get an out of court Agreement of settlement from a Justice of Peace which caused her to pay two hundred and fifty thousand dollars ($250,000.00) compensation to the victim while her two brothers were in custody on a report for fighting. After realizing that she was unfairly treated my assistance as a voluntary social worker was solicited on Monday (2015-12-21) and I immediately accompanied her to the Divisional Commander who promised a through investigation into the matter. A detailed statement was taken from her.
According to the woman, a report for fighting a week ago was made against her brothers but in the process the victim claimed that he suffered the loss of a gold chain and band at a given value of two hundred and seventy thousand dollars ($270,000.00). While at the station, she was advised by the investigating rank to effect a settlement which she rejected and insisted that she would prefer her brothers to be charged and placed before the court.
But after the rank injected the fear in her that the brothers could end up in jail, she decided to make the settlement. With the presentation of the document no charges were instituted against anyone even for fighting. The two brothers who were released on ten thousand dollars ($10,000.00) bail each was given a refund of their money. From the document prepared by the J.P. which was not attested by any witnesses, the victim accepted twenty thousand dollars ($20,000.00) less from the given value of his jewellery which was very strange and becomes questionable.
Information has since surfaced that the victim had placed his missing jewellery in a car which he retrieved and showed to the owner of the vehicle who was promised twenty thousand dollars ($20,000.00) not to say anything to anyone. In my humble opinion such a settlement constitutes a criminal offence punishable by law for perverting the course of justice.
The police are fully cognisant of the fact that the proper forum to effect a settlement is at the courts but obviously this was done for a kick back linked to barefaced corruption which needs to be exterminated from the Force. In the interest of justice, some form of directive from the relevant authority is urgently needed for the police to stop this anomaly once and for all.
