He made several appearances at the Georgetown Magistrates’ Courts for a Preliminary Inquiry (PI) into the murder of Patsan Trading Services salesman, Bharrat Ramcharran.
Always secured by means of handcuffs and foot shackles, Kevin France’s head was always lifted with a smile on his face, whenever he had to be escorted to the courtroom.
After the conclusion of his PI before City Magistrate Judy Latchman, yesterday, 26-year-old France, of East Ruimveldt, was informed that he was freed. He calmly walked out of the courtroom following the announcement.
During the summing up evidence the Magistrate noted that the court had found that there was insufficient evidence against the accused to tie him to the crime.
According to Police Prosecutor, Vishnu Hunt, the evidence, namely a caution statement (CS) and witness to the crime, Anthony Headley, were missing.
France was represented by Attorney, James Bond.
But the same could not be said for France’s co-accused Randolph Marques.
The Magistrate informed the court that a Prima Facie case had been made out against Marques. He was committed to stand trial for the murder in the High Court at the next sitting of the Demerara Assizes.
After informing the court of her decision, Magistrate Latchman asked the remaining accused if he had anything to say. The accused replied in the negative. He said that he had no witnesses to call to testify on his behalf.
The initial charge read that on April 24, 2014 at Campbellville, Georgetown, Marques and France murdered Ramcharran during the course of a robbery.
On Monday, Police Prosecutor Inspector Vishnu Hunt closed his case. His submission, as it relates to Marques, argued that every element of the offence was proven and the witnesses that testified on the prosecution’s behalf were never discredited.
Moreover, Hunt contended that the evidence against the accused suggested that Ramcharran died of gunshot wounds. He said that this evidence was supported by the post mortem report. He added that there was no evidence to support that the victim received further injuries while being taken to the hospital.
According to reports, bandits on a CG motorcycle gunned down the 57-year-old Patsan Trading driver/salesman outside the business place, before escaping with a bag of money, on April 24, 2014.
Ramcharran of Enterprise, East Coast Demerara was shot in the back after he threw a bag of money over the gate of the John Smith Street, Campbellville premises to prevent the bandits from making off with the cash.
The salesman was later rushed to Georgetown Public Hospital where he was pronounced dead.
