Attorney-at-law, Harold Lutchman, is seeking clarification into the allegations made by PPP/C member, Ganga Persaud, in the elections petition seeking to challenge the outcome of May 11 General and Regional elections.
Persaud had challenged the elections results which declared the APNU+AFC coalition winners. In the petition, filed last month, Persaud, who was appointed Election Agent of the List of Candidates for the PPP/C questioned the validity of the recently held polls.
But Lutchman a representative of the APNU+AFC coalition and a third named respondent in the matter, in a summons dated, July 24, 2015, requested “further and better particulars,” in regards to the specifics outlined the case filed by Persaud.
According to the document, the petitioner (Persaud), is asked to supply the court with further and better particulars to paragraphs 8 subparagraphs 1- 15, of the petition, in which he pointed to allegations including that of unrest at various polling stations, fake statements of polls (SOPs) and multiple voting.
The writ filed by Lutchman’s attorneys among whom are Rex Mckay, S.C, Nigel Hughes, and Christopher Ram, further stated that failure by the petitioner to give further and better particulars in a time specified by the court can result in dismissal of the petition.
All parties concerned are asked to be present in the chambers of Chief Justice, on July 30, 2015 at 11:00 am for a hearing on the application made by Lutchman.
Persaud who filed the petition on behalf of his party last month, claimed that the elections were “unlawfully conducted” and the result of the elections was affected or might have been affected by unlawful acts or omissions.
He held that the elections were not held in conformity with the law in relation to elections, more particularly, the Constitution of Guyana and the Representation of the People Act, Chapter 1:03.
The PPP/C representative claimed that the entire electoral process was flawed, and contained many procedural errors and instances of fraudulent and/or suspicious actions.
Unrest, fake statements of polls (SOPs) and multiple voting were among several causes cited when the PPP/C filed its elections petition. Persaud highlighted several areas, in which there were perceived illegalities.
Amongst the wrongdoings listed by the PPP/C member were arithmetic errors in many SOPs; multiple voting by persons at various polling divisions throughout Guyana; persons not on the Official List of Electors (OLE) being allowed to vote; the impersonation of voters and improperly sealed or unsealed ballot boxes.
The presence of “huge mobs” at several polling stations and other strategic places, particularly in Region Four was also cited as another cause. This, Persaud claimed, threatened, intimidated and created fear and tension, which in turn “rendered it impossible for polling and counting agents, duly appointed candidates to carry out their duties and functions properly.
In a section of the document, Persaud stated that he had been in contact on a number of occasions with different Commissioners of the Guyana Elections Commission (GECOM).
According to Persaud, several issues had been raised during meetings between GECOM’s Commissioners and Chief Elections Officer (CEO), Keith Lowenfield, but they were never addressed. As such, the party essentially called for a recount of all ballot boxes for the last elections and fresh elections were also called for.
