Former Supreme Court Judge, Jainarayan Singh, has been asked to formerly write to Attorney General, Basil Williams, on the issues outlined in the case, which he filed against the Government. He had sued for in excess of $50M worth in pension,
gratuity and other benefits.
The matter continued before Justice Nareshwar Harnanan at the Georgetown High Court yesterday. During the private hearing, the request was made by an Attorney representing the AG’s Office. This newspaper understands that it was based on the request that the matter was also adjourned until August 11 at 10:00 for the commencement of a preemptory hearing.
The former High Court Judge, who retired at the age of 62, after eight years of service as a Puisne Judge at the Supreme Court of Judicature, in his original endorsement of claim, named as defendants, the Attorney General of Guyana, the Accountant General, the Judicial Service Commission, (JSC) and Chancellor of Judiciary (Ag) Carl A Singh, in his capacity as Chairman and Member of the JSC.
According to the document, Singh is claiming for entitlement on his retirement to all pensions, gratuity and other benefits of a Puisne Judge given that he had reached the mandatory retirement age.
Citing the Pensions Act and other enactments, Singh noted that refusal by the Accountant General, on the advice of the Auditor General to deny him, his benefits, are made in breach of articles 149B, 213 and 214 of the Constitution. As such, the plaintiff is seeking damages in excess of $50 million for breach of the Constitution and an account of all monies as may be due to him as Puisne Judge on retirement, in particular pension and gratuity.
