…claims officer gagged him with underwear
Colwyn Harding, who is alleging that he was brutally assaulted and raped with a condom-covered baton by Police Constables Devin Singh and Roselle Tilbury-Douglas, will continue testifying on Friday.
Two Thursdays ago, Harding stood in the witness box and gave an emotional testimony at the Providence Magistrate’s Court.
During the start of his testimony, he told the court that on the day in question, he was in the company of his girlfriend, Tenisha Evans, in a house at Timehri.
He recalled that he suddenly saw light in the yard and asked his girlfriend to see what it was.
Harding testified that after Evans did not reply he went to the back door of the house to do his own investigation.
He said that as he approached the door, he saw lights. As a result of this, he said that he called out to enquire who was in his yard.
Harding said that an unknown voice replied, demanding that he “open the f@#king door.” He testified that he refused to comply because the individual failed to identify himself.
Moments later, Harding explained that the back door was kicked open and 10 officers armed with torchlights and guns entered the house. He said that Constable Singh, handcuffed him and dragged him into the bedroom while the other officers continued to search the house.
However, Harding emphasized that Singh had enquired if he was a part of the notorious ‘Hot Skull’ gang, and began to beat him when he denied.
He further explained that when he began to scream, the officer gagged him with his underwear and continued to beat him.
The witness explained that he was then dragged into the kitchen, where he was further interrogated and brutally beaten by the said officer, causing him to drop to his knees.
After this recollection, he broke down in tears which led to the matter being adjourned for a short while. Upon recall, Harding was still traumatized and the Magistrate further adjourned the matter to Friday.
The defendants are being represented by Attorneys Glenn Hanoman and Leslie Sobers respectively.
Both Attorneys, in addressing the court, requested that the matter be dismissed but Magistrate Leron Dailey disapproved.
Singh, of Lot 125 Mon Repos, East Coast Demerara; and Tilbury-Douglas, of Alliance Road, Timehri, East Bank Demerara, are jointly charged with assaulting Harding during the period November 1 to November 13, 2013, at the Timehri Police Station, so as to cause him actual bodily harm.
Devin Singh was also slapped with an additional assault charge.
The duo, who has been on trial since last November, first appeared at the Georgetown Magistrates’ Court on June 3, 2014 and denied the allegations.
Singh was released on $200,000 bail while his colleague was granted bail in the sum of $100,000 by former Chief Magistrate Priya Sewnarine-Beharry.
Harding has alleged that a policeman at the Timehri station pushed a condom-covered baton up his anus in November 2013.
Harding, who was at the time a prisoner having been remanded for allegedly assaulting the cop and resisting arrest, suffered a ruptured intestine. He subsequently underwent corrective surgery in Jamaica, even as a dispute arose as to how he had come by his injuries.
Medical examinations have confirmed that a ‘foreign object’ was inserted into Harding’s anus.
