Dennis Evans, called ‘Die Die’, 36, of Bath Settlement, West Coast Berbice, was on Monday jailed for 10 years by Justice Brassington Reynolds.
The man had earlier pleaded guilty to the charge of engaging in sexual activity with the child, knowing that she was a minor. The act was committed on October 18, 2010.
Justice Reynolds had ordered a probation report which was presented on Monday by Probation Officer, Remesia Lewis.
In her report the officer stated that the man is not well educated, that he dropped out of school at the primary level. He was the seventh of 11 children and dropped out of school early to assist his mother with caring for his other siblings. He has one child who is 14 years old. He later gained employment as a cane harvester.
Evans struck up a relationship with Babita Basil which quickly became an abusive one that soon ended in violence, with the woman expressing continuous fear for her life. The man was feared in the area where he lived and residents were afraid whenever he was around.
Prosecutor Judith Gildharie-Mursalin had related that in October 2010, the accused was sharing a relationship with Seeta Persaud, called Sunita, at 112 Bath Settlement West Coast Berbice.
The relationship was very abusive. During one of the man’s drunken states, he threatened the woman that he would not burn her house again, but that he would show her what he would do.
Evans had earlier come to notoriety when he had allegedly set fire and burnt down Seeta Persaud’s home, on May 28, at Bath Experiment Scheme, West Coast Berbice. Reports had stated that it was the second time he had done so in five years. He was jailed on the two charges of arson.
This time he abducted the child with the intention of taking her to her mother, but instead took her to a burial ground at No. 12 village.
The girl started to scream and the accused threatened to kill her, but she continued to scream. The accused then used one hand to cover her mouth and nose and used his other hand to undress her and insert his fingers into her private parts. He pulled off her clothing as she continued to scream.” Mursalin related.
The child’s screams were heard by a woman who had gone to the burial ground to throw away rubbish. The woman rushed to the direction of the child’s scream and found her alone with marks on her neck and face. The accused had fled the scene.
He was arrested on November 11, 2010 following a sting operation after he had telephoned Seeta for them to meet at a Chinese restaurant. The agreement was made and the police were informed and staked out the area where the man was arrested.
He was represented by Attorney-at-Law Horatio Edmonson. Attorney Edmonson in his plea of mitigation begged the court to show mercy to his client. The lawyer said that his client did not waste the court’s time.
