City Magistrate Judy Latchman handed a drug trafficker a three-year sentence after he was found guilty of trafficking two grams of cocaine.
Daro Peters, 41, chose to give an unsworn statement. He told the court that he did not have the drug in his possession.
During the summing up of the evidence, the magistrate informed the defendant that the court believed he had the substance in his possession. Before handing down her verdict the magistrate took into consideration the mitigating factors and the fact that a strong message needs to be sent to others contemplating of plying the drug trade. She also emphasised about the seriousness and prevalence of drug trafficking in society.
The prosecution facts stated that on the day in question the defendant was stopped and searched by a special constable. Upon searching, the man the police found a creamish substance strapped with rubber bands to his left shoulders. The substance was analyzed by the police and determined to be cocaine.
After hearing he was found guilty, Persaud pleaded with the magistrate. “Yuh Worship, yuh find me guilty. Please for a chance,” were the words he uttered.
Peters made his first court appearance on February 4, and pleaded not guilty to the charge. On that occasion, police prosecutor Shellon Daniels asked that the man be denied bail since he did not have a fixed place of abode.
