…as PI incomplete after almost two years
Four prisoners languishing in jail facing murder charges are appealing to the Director of Public Prosecutions to appoint a new Special Prosecutor. They contend that the present one appears to have limited time on his hand to ensure that they get a speedy trial.
Vishnu Babu, Mohamed Razack, Chetram Diaram and Shawn Caesar were remanded to prison since April 10, 2013, having been charged with the murder of John Derwin McPherson.
The men were all workers on a dredge in the interior. They are accused of beating McPherson to death after he was reportedly caught stealing from their operation.
The Special Prosecutor in the matter is Nigel Hughes and according to reports, he has been requesting several adjournments, citing other pressing matters that he has to attend to.
It’s going on to two years since the preliminary inquiry into the matter started at the Bartica Magistrate’s Court, and the defendants believe that the delay is resulting in them being denied justice.
Three of the accused were initially arrested by the police immediately after McPherson’s death. They were subsequently released on $100,000 station bail, only to be rearrested and charged one month later.
Their preliminary inquiry was started without the fourth accused being arrested.
When the police finally arrested the fourth man, another preliminary inquiry got underway.
Since then there have been several adjournments to the Preliminary Inquiry which is being conducted by Magistrate Delon Bess.
“The Special Prosecutor hardly turns up whenever the matter is called. He keeps asking for new dates. If he’s not in the High Court, it is something else,” one of the accused complained.
The men made their last appearance in court on December 11 and are scheduled to re-appear on January 7.
Hughes is the vice chairman of Alliance for Change. The defendants believe that with General Elections on the horizon, the matter will be further delayed as the attorney at law will definitely be engaged in political activities.
They are therefore urging the authorities to appoint a new Prosecutor, one with a lighter workload, so that justice can be done.
