The Guyana Police Force is upset with the “slap on the wrist” treatment given to persons convicted of Noise Nuisance by the court.
The Force was referring to the decision of Magistrate Zamena Ali to reprimand and discharge a man who had pleaded guilty to Noise Nuisance charges.
The decision was handed down at the Sparendaam Magistrate’s Court yesterday, when Vishnu Ramdial, a businessman of Success, East Coast Demerara went there to answer to the charges.
The police believe that the magistrate’s decision could undermine their work and could deter citizens from pursuing such matters in the court.
According to the police, following police response to a report of Noise Nuisance, Ramdial was brought to the police station where he was processed and released.
After securing his freedom, he proceeded to threaten the complainant, who happens to be his neighbour.
He was later charged by the police with Threatening Language and two counts of Noise Nuisance.
In court the businessman pleaded “not guilty” to the Threatening Language charge and “guilty” to the Noise Nuisance charges.
The Magistrate placed Vishnu Ramdial on bail in the sum of $10,000 in relation to the Threatening Language charge and he was reprimanded and discharged on the two Noise Nuisance charges.
The police explained that Noise Nuisance is plaguing the society, with numerous complaints being made by citizens throughout the country, and consequently the police expend a lot of time and resources in processing Noise Nuisance reports.
“Given the negative impact of Noise Nuisance on the society and citizens’ desire to be relieved of this nuisance, it is expected that sentencing by the Court will serve as a deterrent in an impartial manner,” the Force said in a statement.
A high ranking officer of the Force told this newspaper that while the decision of the magistrate is catered for in the laws of Guyana, she should have taken into consideration the prevalence of the offence and the fact that the defendant is charged for threatening the complainant.
Although the police receive several reports of Noise Nuisance, prosecuting the alleged offenders has been problematic, since the complainants in most cases are reluctant to testify in a court.
“When people come forward (and give evidence) and they see this approach by the magistrate, they become disillusioned,” the officer stated.
The officer however, indicated that the police will maintain their no nonsense approach to Noise Nuisance.
