– Third Class Cricket Club challenges their Expulsion
The Roger Harper led Georgetown Cricket Association (GCA) was prevented from holding their Annual General Meeting on Thursday last.
Kaieteur Sport was made to understand that Third Class Cricket Club’s President Shalim Baksh secured an injunction against the entire Executive Committee of the GCA.
Mr. Baksh is contending that Harper and his executives relegated the Third Class Cricket Club from the Status of founder member with full voting rights to associate member with no voting rights, contrary to the constitution of the GCA. Baksh further stated that this occurred at an OGM to which the Third Class Cricket Club was not invited, based on a letter submitted by Malteenoes Sports Club.
Hon. Chief Justice Ian Chang had ordered in February of this year that the current GCA Executives were illegally in office since January 2013 and the members must meet and decide on a date and venue for elections. It was understood that a meeting was called and three ineligible second division clubs namely Diplomats, Ace Warriors and YMCA voted. Also, Harper and his executives decided to have their January 2013 AGM last Thursday.
These actions were challenged by Nazimul Drepaul a life member of Everest CC and Baksh. However, Kaieteur Sport understands that before the court could hear the matter Harper and his executives decided to expel third class Cricket Club as a full member and replace them with a Team from Sophia.
“Third Class has been a founder member of the GCA and their expulsion requires a constitutional change,” said Baksh, “The Executives of the GCA did not even have the courtesy to invite us to the meeting,” he stated.
Hon. Justice Ramlall ruled on Thursday that, “It is ordered that the respondents by themselves their servants and/or agents, and each and everyone of them and every executive member of the Georgetown Cricket Association whether by themselves or their servants or their agents of the said association or otherwise howsoever be and are hereby restrained and an injunction is hereby granted restraining the respondents and each and everyone of them and each and every executive member of the Georgetown cricket association, whether by themselves or by their servants and/or agents of the said association or otherwise howsoever from calling or holding the Annual General Meeting fixed for 20th November 2014 or any other Annual or Special General Meeting of the Georgetown Cricket Association and from taking any decisions or passing any motions and/or resolutions or electing ant Executives at any such Annual General Meeting of the 20th November 2014 or at any other Annual or Special General Meeting of the Association until after the hearing and determination of a summons in this cause returnable for the 5th day of December 2014 at 9.15 pm”. The honourable judge went on to order service.
Kaieteur Sport was told that only clubs that were eligible to vote in Jan 2013 can participate in the deferred AGM and that Ace Warriors and Diplomats only appeared to have played recently in the GCA second division cricket, whereas YMCA, on the other hand has not played any cricket for at least 10 years and it is totally illegal to be including Sophia at this time.
When contacted, Harper said the decision to demote Third Class was not taken by the Executive committee, but members of the GCA. He informed that a member club wrote to the GCA, questioning Third Class’ eligibility and it was found out that they are not based in Georgetown and as such they did not meet the criteria and the members voted in favour of them being demoted.
Harper said that the club was invited to the OGM but did not turn up. He pointed out that following the court order in February a decision was taken to hold the AGM on November 20, but Third Class and Nazimul Drepaul went to the Court saying that Ace Warriors, Diplomats and YMCA should not be allowed to vote and the case is fixed for December 3 before Chief Justice Ian Chang whereas the matter concerning the AGM will be heard on December 5.
