…claims he did so to defer severe trashing
A father of five was ordered to post a fine by Chief Magistrate Priya Sewnarine-Beharry after he admitted to pelting a box of human faeces that was sitting in the station lockups at two police Constables.
Peter Graham, a carpenter and part-time gold miner who appeared at the Georgetown Magistrates’ Court, claimed that he was being beaten by the two ranks in the cell at the Lethem Police Station lockups so he picked up the box of faces and hurled it at them so they could stop.
Graham faced five charges before the Chief Magistrate yesterday.
The first charge read to him alleged that last Friday (September 26) at St. Ignatius Village Community Centre in Lethem he stole a Blu cellular phone valued $70,000 from Marvin Peters.
Responding to that charge, Graham said “I not guilty really but I see Anderson (a person released on bail on a larceny from the person charge before his arraignment) get $50,000 bail but me ain’t get that sort of money…I gun stay in jail please.”
The other charges read to him alleged that on the same day at the Lethem Police Station lockups, he unlawfully assaulted Assistant Superintendent of Police (ASP) Rooplall and Constables Sobers and Browne.
He was also charged with behaving disorderly at the Police Station.
While he denied assaulting the ASP, Graham admitted to behaving disorderly and assaulting the two Constables.
Police Prosecutor, Inspector Michael Grant explained that about 10:45 hours last Friday, Peters was on his way home after attending a village function at the community centre when Graham snatched his cellular phone and ran away.
He said that the matter was reported to the police who later received a tip and managed to arrest Graham.
According to the Prosecution, Graham, while in custody, was speaking loudly and was heard using a series of “fs and ss.” Grant said that he was spoken to by the ASP and as the Police Constables were about to enter the cell, Graham armed himself with human faeces and threw it at them.
In his defence, Graham said “In the lockup they beat me in my stomach…Yes I throw the sh*t at the officers. I made several complaints at the station that people wrong me but they don’t do nothing.”
He explained that he was once stabbed to the neck and he went to the Lethem Public Hospital to do a medical. He claimed that he had been informed that the police had received it but he was never called for a court date.
Graham claimed that another time 15 pennyweight of gold was stolen by a “Rasta man” and the police had taken a bribe and swept the story under the mat. “They lock me up now but I didn’t steal anything,” the man lamented.
“I pick up the shit – that lockup full of shit and I pick up the box it been in and throw it at them. They was beating me so I pick it up and throw it at them,” Graham told the court.
After explaining that he had contacted Kaieteur News’ Lethem correspondent who assisted him with contacting the police, Graham said “Your honour, me ain’t get money to go through all these things…I got six children – just let me go. See wah you gun do.”
He further added that the ASP was outside standing by the cell while the ranks trashed him. He alleged that the rank who brought the charge before the court was the one who told him “to shut up” about the story involving the gold.
After listening to his story, the Magistrate advised him to visit the Office of Professional Responsibility (OPR) and Police Complaints Authority (PCA) to lodge his complaints. The Prosecution was also instructed to launch an investigation into the man’s claims.
Despite his insistence to be entered into guilty pleas, the Magistrate told him that she could not do that since he said he had neither assaulted the ASP nor stole the cellular phone.
Graham told the court that he had faced the court before on wounding, assault and a simple larceny charge.
Prosecutor Grant objected to bail for the charges he denied and added that Graham had been convicted on a simple larceny charge in 2012 but the accused insisted that it was in 2005.
For behaving disorderly, he was fined $10,000 with an alternative of two weeks imprisonment while for assaulting the Constables he was fined $20,000 with the option of spending one month in jail.
For the other three charges, Graham was remanded to prison until October 1 offering the Prosecution a chance to check his records to see when he was convicted.
