A man charged with attempted murder is to stand trial in the High Court following the ruling of Chief Magistrate Priya Sewnarine-Beharry yesterday.
Troy Marcus is charged with attempted murder after he allegedly picked up a cutlass and dealt several chops to his friend, Etwaroo Ronald Narine on July 6, last.
The chopping reportedly stemmed from a dispute between the two while they were drinking at a shop in McDoom on the East Bank of Demerara.
Four days after the incident Marcus was brought to the Georgetown Magistrates’ Court to be arraigned. The Prosecution had explained that Narine was in a shop at McDoom drinking when the accused approached him and an argument ensued between them over money.
It was during that time that Marcus armed himself with a cutlass and dealt Narine several chops about his face and body. Marcus was rushed to the hospital where he was treated and hospitalised for a period of time.
The matter was later reported and Marcus was arrested and charged.
Ever since his first arraignment on July 10, last, Marcus has been kept in custody and the Preliminary Inquiry started on Monday.
During the pre-trial proceeding, the court heard testimonies from Narine (the victim), the shop’s owner, two other civilians and two police ranks.
At the end of the two-day committal hearing yesterday, Inspector Michael Grant closed the Prosecution’s case and the Chief Magistrate ruled that a Prima Facie case of attempted murder had been made out against Marcus.
When Marcus was asked if he had anything to say in his defence, he at first tried pleading to the charge but was told that his plea cannot be taken in the Magistrates’ Court.
After the court sought the indulgence of Attorney-at-Law Paul Fung-a-Fat to appear amicus curiae, Marcus said “I wish to remain silent. I am innocent and I will call my witnesses in High Court.”
The Chief Magistrate indicated that based on the evidence brought before her, she is of the opinion that a sufficient case of attempted murder was made out against Marcus to stand trial in the Supreme Court.
She informed him that she will be sending him before the judge and jury to stand trial for murder and that the court’s registrar will contact him when his case is called up.
