… Probation report ordered
The mixed jury in the trial of murder accused Naresh Ramjohn called ‘Naresh Mahase’ or ‘Sadam’, 35, of Stanleytown and Angoy’s Avenue, New Amsterdam, returned with a unanimous guilty verdict, yesterday. Samaroo was on trial before Justice Navendra Singh and a mixed jury in the Berbice High Court, for the 2008 murder of Anthony Samaroo, called ‘Scare them’, 28, of Levi Dam, Angoy’s Avenue, New Amsterdam, Berbice.
The offence was alleged to have been committed on July 2, 2008, at Levi Dam, Angoy’s Avenue. The accused showed no emotions at the verdict.
Sentencing was postponed to September 25 after the defence requested that a probation report be submitted.
Earlier, both the defence, led by attorney-at-law Mursalene Bacchus in association with Perry Gosai, and the prosecution which was conducted by attorney at law Renita Singh made their submissions before Justice Singh and the mixed jury.
Attorney-at-law Perrry Gossai in his submission concentrated on the credibility of the witnesses, the inconsistencies and the discrepancies in the statements by the two prosecution main witnesses.
Prosecutor Singh reminded the jury that two of the dead man’s brothers gave evidence that they witnessed the death of their brother. She said that from the evidence of the brothers they knew the accused. They lived in close proximity and would see each other constantly.
She summed up that it was Ryan, one of the brothers, who stated that he was in the lock-ups with the accused when he told police that he was the person who killed Samaroo two years earlier.
The prosecutor in her address told the jury that not because the witnesses may have had questionable characteristics should people not believe what they said.
Justice Singh then summed up the case for the jury in which he asked them to determine from the evidence, whether it was the accused that inflicted the injury that caused the death of Anthony Samaroo.
The judge also stated that the prosecution produced two witnesses who both gave evidence that they saw the accused inflicting wounds on the deceased and it was up to them to believe what they heard.
The Prosecution had called some eight witnesses including Tajepaul and Ryan Samaroo, the two brothers of the deceased, who were supposedly with him on the day of the incident. They had both testified to the sequence of events on the day in question and of seeing the accused inflicting injuries to their brother.
The men were both cross examined by Attorney at law Bacchus who made moves to discredit their testimony. Mr. Bacchus made mention that Tajepaul gave his statement some 23 days after the incident. He also said that Ryan gave his statement nearly two years after the incident.
Pathologist Dr. Vivikananda Brijmohan who performed the post mortem examination on Anthony Samaroo at the New Amsterdam hospital had revealed that he died from shock and haemorrhage due to multiple stab wounds.
Also called during the trial were the dead man’s mother, Meena Persaud, and his father Tony Samaroo. Detective Corporal Lawrence Thomas, Detective Lance Corporal Denesh Baichu and Corporal Brandt were also called. .
In her opening address Prosecutor Singh had detailed that on the day in question, Ryan Sameroo was walking on Levi Dam, when he was confronted by the accused.
Ryan did not respond but continued walking until he noticed his brother, Tejpaul. After speaking for a few minutes they looked up the street and saw Ramjohn and his two brothers, ‘Joe Boy’ and ‘Baboo’, with implements in their hands.
The Samaroo brothers went home and told another brother Anthony Samaroo what had transpired.
The brothers left and went back to Levi Dam, where they were attacked. Ryan and Tejpaul were able to escape. Ryan was standing some distance away and saw when Ramjohn stab his brother. Ramjohn then instructed his brothers ‘to ‘Done he, done he.’
The two remaining Samaroo brothers then ran home and told their mother what was happening. They returned immediately together to Levi Dam, where they saw Anthony lying on the ground in a pool of blood.
Two years later, in May 2010, both Naresh Ramjohn and Ryan Samaroo were arrested for separate matters and ended up in the same lock up. Ryan Sameroo used the opportunity to inform the police that Naresh Ramjohn was the person who had murdered his brother. Ramjohn was later charged with the capital offence.
