A West Coast Berbice man who took advantage of a child when she was only eight years old back in 2009 has been found guilty on the charge of Carnal Knowledge. He was jailed for 25 years by Justice Navindra Singh after he was found guilty of the crime by a mixed jury sitting in the Berbice High Court.
The Hopetown Village resident, Talbert McPherson called Tally, who was 37 at the time, had been accused of committing the act between Wednesday 12th August and Thursday 13th August 2009 at No 30 Village, West Coast Berbice.
The case was prosecuted by State Prosecutor Renita Singh while the accused was represented by attorney Raymond Alli.
The indictment had read that the man had Carnal Knowledge of a girl under 15 years of age.
The child had stated that she lived with her mother, aunt and a cousin (at No. 30 village). She knew the accused because he lived with her grandmother and aunt. On the day in question, her mother took the two children to her grandmother’s residence to stay for the night, because she was attending a wake.
Early in the night they watched a movie with her grandmother after which she and her cousin retired to bed. She was lying on a mattress with others when she saw a shadow. The light from outside was shining in the room and she recognized the person to be Talbert McPherson. He subsequently had sex with the child and left.
The next day she informed her mother who reported the matter to the police. The child was taken to the hospital where it was observed that she had bruises on her vaginal wall and anus. The accused was arrested and charged.
During the trial the prosecution called eight witnesses including the virtual complainant, her mother, grandmother, a doctor and police officers, Doris Williams, Detective Constable Randry Hendricks and Dwayne Harvey.
Earlier in the day, the Judge had summed up the evidence after the prosecution and defence had closed their case.
The jury after their deliberations returned with a unanimous verdict of guilty.
His lawyer in a plea of mitigation had stated that his client was young and was never before the court on any crime. He also begged the court to show mercy.
When the accused was asked by the judge if he had anything to say, he said “Sir with all due respect I am not a violent person. I did not take a life of a person and am still in trouble. I did not do it.”
Justice Singh in responding told the accused that he found the statement that he made strange. He asked the accused if he is sick, and stated that he cannot imagine any person who would want to do something like that to an eight-year-old.
When asked by the judge if he had ever been before the court, the accused was non-commitant, while stating “Sir these people are always after me, they always after me”.
The judge then sentenced him to 25 years in jail.
During the interval for deliberation, the accused was seen reading a bible and singing hymns. He and his wife both burst into tears after the verdict was read.
