Attorney at Law Murseline Bacchus is challenging a Magistrate’s decision to commit his client to stand trial in the High Court on the amended Sexual Offences Act.
Mr. Bacchus representing Ray Bacchus, has moved to the court for an order directed to the Director of Public Prosecution, the Commissioner of Police and Magistrate Sherdel Isaacs-Marcus, to show cause why the mMagistrate’s decision handed down on June 2, last, committing Ray Bacchus to stand trial for rape should not be quashed.
Ray Bacchus, a father of three, was charged on August 28, last, at St. John Street, New Amsterdam Berbice, for sexual penetration of a child aged 14.
Attorney- at- law Bacchus in his application stated that his client was charged indictably with rape of a child under 16 years of age.
Ray Bacchus, in his affidavit is stating that his Attorney, Mr. Murseline Bacchus, was not permitted to cross-examine the witness whose statement was filed by the prosecution. Nor was he permitted to give evidence or call any witness before he was committed.
He is contending and believes that his committal on June 2, last, is null, void and of no legal effect. He is also contending that the said committal cannot be used for the purpose of a lawful indictment by the Director of Public Prosecution against him.
After hearing the affidavit submitted by Attorney at Law Mr. Murseline Bacchus, Chief Justice Chang ordered that an Order be issued directing the Director of Public prosecution, the Commissioner of Police and Magistrate Sherdel Isaacs-Marcus to show cause why the decision of the said Magistrate should not be quashed.
