A senior city Magistrate yesterday remanded a 28-year-old man following the road accident that claimed the life of a
Grade Two St. Pius Primary School pupil, recently.
Jermaine Carrol, who identified himself as a maintenance worker from Church’s, was yesterday taken before the Georgetown Magistrates’ Court and formally charged for the death of 7-year-old Joseph Quallis. He was also charged with driving an uninsured car.
The first charge which was read to him by Chief Magistrate Priya Sewnarine-Beharry detailed that on June 12, on Freeman Street, East La Penitence, he drove in a manner dangerous to the public, while piloting motor car PPP 5831 thereby causing Quallis’ death.
He was accused too of using the said car which, at the time, was not covered by third party risk insurance.
To the allegations, he pleaded not guilty and submitted an application for bail. Carrol, who was unrepresented by legal counsel, told the Magistrate he had never been charged before.
Corporal Bharat Mangru, the Prosecutor, said that on the day in question the accused was driving west along the southern half of Freeman Street, East LaPenitence, at a fast rate.
The driver, he said, then lost control of the vehicle and it collided with the seven-year-old student who was at the time standing on a concrete bridge on the southern side.
The vehicle reportedly crashed into a fence pinning the child.
Quallis, a resident of La Penitence, was taken to the Georgetown Public Hospital Corporation (GPHC) where he subsequently succumbed to injuries sustained during the accident.
The Prosecution noted that it was during investigations that ranks discovered that Carrol was driving an uninsured vehicle.
He was later taken into police custody and charged for the offences.
Corporal Mangru offered objections to bail citing that the accused had several matters but had constantly been evading the police. On this ground, Mangru opined that Carrol is a flight risk and may not return to court to face the charges.
The Prosecution urged the court to consider too, the prevalence of fatal accidents in society as well as the penalty the offence attracts and deny the accused bail.
The Chief Magistrate upheld the objections of the Prosecution and remanded Carrol to prison. The case will be called again on July 4 for statements.
