DCB Board injunctions still in effect
Dear Editor,
We wish to respond to an article published in the Kaieteur News of June 12, 2014 and captioned “Roger Harper/Anandjit court action stayed”.
This article stated: “Another court action in cricket has been stayed. In this matter, Mr. Roger Harper and Davteerth Anandjit filed an action against all the officers of the Demerara and Guyana Cricket Boards”.
However, the fact is that, in this matter the Hon. Justice William Ramlall simply ordered: “UPON HEARING Attorney-at-Law for the Plaintiffs and for the Defendants IT IS HEREBY ORDERED AND DIRECTED that the hearing of whether or not the Interim Injunction should be made interlocutory herein be and is hereby stayed until the hearing and determination of an Appeal in Civil Action No. 59-W of 2011 Demerara in the Full Court of the Supreme Court of the Judicature which includes a similar cause of Action as in this Action.”
This article was intentionally crafted to mislead the public and apparently the Courts. The Injunction granted by Madam Justice Sandra Kurtzious clearly barred the purported Executive Committee of the Guyana Cricket Board (GCB) from acting but was put on hold by the Hon. Full Court of the Supreme Court until the matter is heard on the 17th June, 2014.
The Hon. Justice William Ramlall had, on June 6, 2014 regarding the Demerara Cricket Board (DCB) matter ruled: “ IT IS HEREBY ORDERED AND DIRECTED that the hearing of whether or not the Interim Injunction should be made interlocutory herein be and is hereby stayed until the hearing and determination of an Appeal in the Civil Action in the Full Court of the Supreme Court”.
The Orders / Injunctions blocking RAJENDRA SINGH, LALTA DIGAMBER, ANAND SANASIE, ALFRED MENTORE, ANAND KALLADEEN, RAVINDRANAUTH PERSAUD, RONALD SARJOO, NAZIMUL DREPAUL, COLIN EUROPE, RAY PERSAUD, KRISHNCHAND MANGAL, CHETRAM SINGH, LIONEL JAIKARAN, RAMSEY ALI, FIZUL BACCHUS, DRU BAHADUR, TROY MENDONCA, RAYON GRIFFITH from holding elections of the Demerara Cricket Board (DCB) and from acting or performing any function or duty as executives of the DCB are still in effect.
No Injunction or Court Order concerning the DEMERARA CRICKET BOARD (DCB) was either put on Stay of Execution or discharged by the Hon. Justice William Ramlall.
The article went on to say that the Vice-President of the GCB Mr. Fizul Bacchus, who was present in Court, in an invited comment, had stated that the officers of the GCB and the DCB continue to meet their obligations.
These statements clearly illustrate a profound disrespect for Justice Ramlall and a blatant disregard for the rulings of the Court. We believe that Mr. Fizul Bacchus’s well-rehearsed statement was made to deliberately mislead the public into believing that there is a legally-constituted Executive Committee of the DCB.
His public statement: “Another court action in cricket has been stayed” was used cunningly in a pathetic attempt to give credibility to the illegal Guyana Cricket Board elections.
Bacchus further attempts to deceive by stating that Civil Action No. 59W of 2011 (Krishnchand Mangal vs Bissoondyal Singh et al) is in the Full Court. It is not. That matter is also currently before Hon. Justice William Ramlall.
Mr. Editor, we feel some amount of disquiet with the way these individuals continue, with impunity, to misrepresent the facts in their efforts to mislead and deceive the public and yet secure the attention of the newspapers. Court cases are not subjective matters and editors must ensure absolute accuracy to ensure that there is factual reporting.
In the meanwhile, we remain steadfast in our crusade to bring back decency, legality and accountability to our cricket.
