The Hogstye murder trial of a man and his son continued in the Berbice High Court yesterday with the Prosecution star witness taking the witness stand for the entire day. He was still there when the case was adjourned for the day.
Krishna, called ‘John’, 50, of Alness and Letter Kenny, Corentyne; and his son, Rommel Krishna, 24, of Alness Corentyne, Berbice; are being tried before Justice Brassington Reynolds and a mixed jury for killing Shawn Fraser, between July 27 and July 28, 2011 at the above location.
The men are being represented by attorneys at law, Kim Kyte-John, who is representing Krishna called John, and Murseline Bacchus who is appearing for Rommel Krishna.
The state is being represented by Prosecutor attorney at law, Renita Singh.
When the matter continued yesterday the prosecution star witness, Audwyn Bindah, called ‘Audwyn Fraser’ took the witness stand.
Bindah, who was also shot during the incident, gave a detailed recount of the events on that day. Led by Prosecutor Renita Singh he recounted that he and his brother left home to go to the back dam to tend to their rice field.
He said that they were confronted by the accused and subsequently shot. He said that he saw the men shoot his brother. He, although injured and being pursued by the men, had to flee for his life. He also told how he ended up in the company with another brother.
Also testifying in the matter so far, are Detective Assistant Superintendent of Police, Gary Mc Alister. Mc Alister stated that upon receiving certain information on the day in question, he led a party of policemen into the back dam. They journeyed down the Saltan dam into the backlands then crossed over into Saltan Village before reaching Hogstye dam. There they found the body of Shawn Fraser.
Detective Sergeant Gilbert Ross had testified that he and a party of policemen had journeyed to the back dam where they found Fraser’s body.
Detective Corporal Andrew Ward also testified to the part he played during the investigation. Police Corporal Harold Noble who was in charge of the shift at the Whim Police Station when Krishna, called ‘John’, was taken in by his attorney, was among the witnesses.
Two sisters of the deceased have also testified so far. Raquel Fraser related to the court that she had identified the body of her brother during the post mortem examination. Kim Providence testified to the series of events that took place during the day, including the time the brothers left home to when she learnt of the incident. They were all grilled by Mr. Bacchus and Kim Kyte John.
In her opening address state Prosecutor Renita Singh had revealed that on July 27, Shawn Fraser and his brother Audwyn Bindah, called ‘Audwyn Fraser’ of 11 Adventure Farm Corentyne, as farmers, left their home to attend to their rice field at the Hogstye back dam.
On their way they saw three men Krishna called ‘John’, his son Romell Krishna, called ‘Romell’, and one ‘Bobo’ in the back dam.
The brothers had completed their work and were on their way out when they were attacked and shot by the three men.
Audwin was rushed to the Port Mourant Hospital then transferred to the New Amsterdam Hospital. Shawn Fraser’s body was picked up and taken to the Port Mourant Hospital where he was pronounced dead.
A post Mortem examination was later conducted on the body of Shawn Fraser at the New Amsterdam hospital by Dr. Nehaul Singh. It gave the cause of death as perforation of the lung due to penetrating wounds to chest, compounded by a fractured skull.
The day’s proceedings ended with the Prosecution making a request for the court to visit the scene.
A ruling is expected to be made on the request today after further arguments.
