Two witnesses took the stand when the murder trial of a man and his son who are charged with the shooting to death of a Corentyne farmer following a dispute, continued in the Berbice High Court.
The duo Khrishna, called ‘John’, 50, of Alness and of 85 Letter Kenny, Corentyne, and his son Rommel Krishna, 24, of 69 Alness, Corentyne, Berbice, who are both farmers are on trial for murdering Shawn Fraser, between July 27 and July 28, 2011, at Hogstye Back dam, Corentyne Berbice.
The matter is being tried before Justice Brassington Reynolds and a mixed jury.
The men are being represented by Attorney at Law Kim Kyte-John, who is representing the number one accused and Murseline Bacchus who is appearing for Rommel Krishna.
When the matter resumed, State Prosecutor Renita Singh in her opening statement, said that Shawn Fraser and his brother, Audwyn Bindah, called ‘Audwyn Fraser’, of 11 Adventure Farm, Corentyne, are cattle and rice farmers. On July 27, 2011, they left their home to attend to their rice field at the Hogstye Back dam.
On their way they saw three men Krishna, his son Rommel Krishna, called ‘Rommel’ and one Bobo, plowing with a tractor on a cross dam. The brothers made a stop opposite where the men were plowing to attend to some work. One of them then noticed the men had stopped working and were under a tree in front of the reef.
The brothers subsequently finished spraying their field and were on their way out, when they saw the three men on top of a reef armed with a shotgun each. The men then suddenly opened fire hitting the brothers.
Audwyn managed to escape and ran for about ¼ mile to where another brother, Ray Fraser, was in a nearby farm, tending to his crop. Ray had heard what sounded like gunshots, and saw his brother Audwyn Bindha, running towards him with blood all over his body and the men with a gun each in their hands.
Ray then saw the men shoot at his brother, Audwyn Bindha, who subsequently collapsed. The attackers turned back and escaped out of the rice field. Ray in the meantime, went to his brother’s assistance and saw that he was covered in blood and had holes on his back and left side chest.
Ray made contact with a number of other siblings who all converge on the scene.
One of the sisters Kim Providence had seen two men, Rommel Krishna and Kevin under a shed. The men had enquired from her the where about of another brother, Jermaine, and she cursed him.
The police subsequently arrived on the scene and managed to arrest the two men.
Audwyn was rushed to the Port Mourant and then New Amsterdam Hospital. Shawn Fraser was picked up and taken to the Port Mourant Hospital where he was pronounced dead.
A post Mortem examination was later conducted on the body of Shawn Fraser at the New Amsterdam Hospital by Dr. Nehaul Singh, which gave the cause of death as a perforated lung due to penetrating wounds to chest compound by a fractured skull.
Taking the witness stand first was Raquel Fraser who related to the court that she had identified the body of her brother during the post mortem examination.
Next on the witness stand was Kim Providence who related to the court that on the day in question her brother left for the Back dam on a tractor. Sometime in the afternoon she received a telephone call. She subsequently, in company with others, went to the Back dam.
During the journey Providence stated that she had seen two men, Rommel Krishna, and Kevin under a shed. Rommel had enquired, ‘Whay Jermaine deh’. She testified that she had cursed him.
They eventually arrived were the badly wounded Bindha was lying and they picked him up and rushed him to the nearby health facility.
The witnesses were both cross examined by the defence attorney. The matter is continuing.
