The two persons implicated in the Mandela Avenue shootout, which resulted in the death of Elvis Fernandes, last June, have been committed to stand trial during the next practical sitting of the Demerara Criminal Assizes at the Georgetown Supreme Court.
Yesterday, Chief Magistrate Priya Sewnarine-Beharry, told co-accused Britton and Thomas that the evidence presented by prosecution witnesses during the Preliminary Inquiry (PI) has proven sufficient for them to stand trial before a Judge and Jury at the High Court.
Lloyd Britton and Jermaine Thomas were charged with Fernandes’ murder, days after the incident occurred on Mandela Avenue.
The matter was prosecuted by Police Corporal Bharat Mangru, while the accused were represented by Attorneys- at -Law Dexter Todd and Peter Hugh
According to the detail of the case, Fernandes was shot during an altercation with occupants of a minibus which included, Britton.
During the gunfight, Britton allegedly shot Fernandes and was himself wounded by a police rank, who intervened.
However, Britton had denied having a firearm and suggested that the same policeman, who wounded him, also shot Fernandes.
Fernandes was slain during a confrontation with minibus driver Adrian Brandt and passenger Britton. Brandt had said that he was driving along Mandela Avenue that day, when Fernandes, who was on a scooter, and another man, in a silver car, blocked his path.
The driver reportedly accused Brandt of scratching one of his car mirrors during a collision on a previous occasion.
Britton was in his front seat, intervened, and the men began to threaten Britton, while Fernandes called the passenger a ‘thief.’
But a police patrol reportedly arrived and ordered the men to disperse. The ranks also reportedly suggested that the owner of the car file a report about the alleged accident.
Brandt then returned to the West Ruimveldt Minibus Park, where he picked up other passengers, while Britton remained in the minibus. Brandt was driving east along Mandela Avenue a few minutes later when the same car intercepted him.
He alleged that a police rank emerged with a handgun, while the driver had a cutlass and Fernandes had an ice-pick.
Fernandes ran towards the conductor’s side of the bus, the driver of the car with the cutlass and Lloyd Britton, exited the bus when the men emerged from the car.
Brandt had said that shortly after he heard gunshots and saw the policeman shooting. His passengers began to scream and urged him to drive away, but then Britton clambered back into the vehicle and said “I get knock.”
It was then that the injured Britton reportedly handed the gun over to his alleged accomplice, Jermaine Thomas.
