Former beauty queen, Carolann Lynch has been set free three months after a murder charge was reinstituted against for the death of her husband, former Managing Director, of Swiss House Cambio, Farouk Razac.
Lynch became emotional yesterday, as Chief Magistrate Priya Sewnarine Beharry announced that she had been discharged of the murder charge, which occurred in 2007, due to insufficient evidence.
This is the second time that the former beauty queen faced the court for the murder of her husband. Lynch was accused of murdering the wealthy businessman at their Bel Air Park home on May 7, 2007.
In 2008, Magistrate Gordon Gilhuys had discharged the first case against her due to an absence of enough evidence. Two years later the Director of Public Prosecutions (DPP), Shalimar Hack had recommended that a fresh murder charge be reinstituted.
During the second Preliminary Inquiry (PI), several witnesses were called upon to give evidence in the matter. The witnesses included Lynch’s teenage daughter, her niece, Melissa Watson, as well as her personal trainer, Karan Dutt.
They all testified about the events in the hours leading up to the discovery of Razac’s body in his home.
Lynch’s daughter had said that her mother and Watson had left to take her to school on the morning of the incident, while Dutt recalled making arrangements on the phone with Carolann to hold a training session.
At the commencement of the proceeding, Attorneys-at-Law Peter Hugh and Latchmie Rahamat in their representation of Lynch told the court there is definitely no new evidence that warrants her being recharged.
In her final arguments before the court yesterday, Rahamat maintained that the Prosecution has brought absolutely no new evidence against her client. Rahamat noted that based on the material presented, there was not even circumstantial evidence to prove that Lynch committed the act.
“The handyman had access to the house but he was never charged…The police were not able to prove that the injuries which Farouk Razac received according to their reports were in fact inflicted by Carolann Lynch,” Rahamat said
Police Prosecutor Sergeant Bharat Mangru called a total of seventeen witnesses to the stand during the PI which lasted for several weeks.
However, Chief Magistrate Sewnarine-Beharry said the prosecution failed to establish a case against Lynch, after listening to the testimonies of the witnesses and the arguments presented by both the prosecution and the defense.
After announcing that the court had found that there was insufficient evidence for the accused to face trial by a judge and jury, the Chief Magistrate told Lynch that she was free to go.
The visibly relieved woman left the courtroom swiftly. She met with her relatives who were waiting outside. After embracing his daughter, Lynch’s father expressed gratitude to members of the Guyana Police Force for the way in which she was treated while in custody.
When asked what were some of her immediate plans now that she’s free, Lynch said that she is going to church since she wasn’t able to attend in a long while.
