General Practitioner Dr. Mohan Persaud told the court yesterday that he had examined Charles Cush and Jevon Wharton after they were arrested for their alleged involvement in the rape and murder of nine-year-old Sade Stoby.
After being deemed an expert in his field of medicine by the court, Dr. Persaud read out his finding in relation to examinations which he had conducted on the two accused.
Persaud told the court that he found lacerations and abrasions on the private areas of the two men which suggested their involvement in sexual intercourse, “particularly in a forceful manner”.
According to Dr. Persaud, on November 4, 2007, he interviewed and examined 16-year-old Jevon Wharton and 18-year-old Carlos Hubbard, in the presence of Detective Constable Devon Bowen. The two boys were initial suspects of the crime.
“Based on a conversation I had with the Detective, I proceeded to interview and examine the two individuals separately…I conducted a complete examination of the body and genital area of Jevon Wharton… I recorded my finding on a medical form provided by the Detective… The examination conducted on the uncircumcised penis of Jevon Wharton revealed lacerations to the head and lower aspects of the penis …abrasions to the head and shaft of the penis…”
However, the doctor noted that the injuries could have been caused by frequent masturbation, or due to a Sexually Transmitted Infection (STI), or a yeast infection.”
At this point, Prosecutor Judith Gildharie-Mursalin made an application for the medical record of Carlos Hubbard to be tendered into evidence before the court. Hubbard was initially arrested for the crime but was later released based on advice from the Director of Public Prosecutions, (DPP).
Mursalin’s application met with objections from the Defence Attorneys, George Thomas and Raymond Alli, but Justice Navindra Singh subsequently overruled, allowing Hubbard’s medical record to be tendered as evidence before the court – according to which, the doctor said that no marks were found on Hubbard.
Dr Persaud subsequently read out the medical record of Charles Cush.
“The medical examination conducted on the body of Charles Cush revealed an abrasion to the left shoulder and multiple abrasions and lacerations on the penis area which suggests involvement in a forceful sexual exercise.”
Government Pathologist Dr Nehaul Singh also presented his evidence to the court, in accordance with the post mortem examination, which he conducted on the body of Sade Stoby, on November 5, 2007.
“The body was bloated, the eyes were bulging, the hands and feet were wrinkled, which suggests that it was submerged in water for some time, there was evidence of haemorrhage from the head and neck. The brain had started to decompose; there was thick black mud in the trachea or the wind pipe, which suggests breathing while under water. There was bruising on both sides of the vagina and the hymen was ruptured which suggests forced entry or forceful sexual activity just before the time of death. Her intestines were also protruding…. which could suggest possible sexual activity,” Dr Singh explained.
The doctor revealed the cause of death to be asphyxiation due to submersion (drowning) and blunt trauma. He later explained that child may have died between 46 hours to five days.
At the opening of the case, Prosecutor Mursalin gave the court a detailed and gruesome report of how the body of a little girl, who had gone missing for three days, was discovered near a ditch a short distance from her Barnwell North, Mocha Arcadia, East Bank Demerara home.
The evidence suggested that the girl had been raped and murdered. After the discovery was made, the child’s alleged killers were identified to be two teenagers who lived in her village, Wharton and Cush.
Wharton, now 23 years old, and his alleged accomplice Cush, 21, are being represented by Attorney Raymond Alli and George Thomas, respectively.
