An alleged gun-toting porter was yesterday remanded to prison by a senior Magistrate for reportedly opening fire at his victim during a struggle over an expensive gold band.
Yesterday morning, Liston Marcus of Lot 15 ‘CC’ John Fernandes Park, Georgetown, appeared at the Georgetown Magistrates’ Court before Chief Magistrate Priya Sewnarine-Beharry charged with armed robbery and discharging a loaded firearm.
On April 25, at West Ruimveldt, Marcus allegedly armed himself with a gun and robbed Alvin Daniels, of his $600,000 gold band. He was also accused of discharging a loaded firearm at Daniels with intent to maim, harm or disfigure him.
After the Administration of Justice Act (AJA) was applied to both charges, he pleaded not guilty and urged the Magistrate to consider offering him bail.
An evidently battered Marcus explained, “On Tuesday, after I came off from work, my grandmother send me to buy a loaf of bread to eat. I see a group of boys just come running towards me. They just catch me and beat me up.”
“Your worship, I just came from work and was heading to buy bread for my next day at work and these people just come beating me just so.”
The court heard that he has had no prior convictions or charges.
Prosecuting, Inspector Michael Grant explained that about 19:30 hours, the victim was in West Ruimveldt along with others when the accused, in the company of others, approached him.
Daniels was at the time wearing the gold band when Marcus brandished a gun and demanded he hand over the hand band. He managed to relieved him of it but the victim retaliated and then a scuffle ensued between the two, the Prosecutor explained.
During the struggle, Marcus is accused of firing several shots at the victim resulting in injuries before he escaped. However, public spirited citizens chased him and managed to apprehend him.
The accused was later charged for the offences.
Inspector Grant offered several objections to him being granted bail.
He urged the court to consider the serious nature, gravity and prevalence of the offence as well as the fact that a firearm and extreme violence were used thereby causing the victim injuries, and deny him bail.
Responding, the Chief Magistrate upheld the objections of the Prosecution and ordered him held. The case is set to be called again on May 22 for statements.
