The attempts of a woman to recant evidence against her reputed husband who is before the courts for trashing her in the presence of her children were cut short by a city Magistrate who, in response, has since called in a specialized non-governmental organisation to assist the woman.
Lingsford Benjamin is currently being prosecuted before Magistrate Geeta Chandan-Edmond at the Georgetown Magistrates’ Court for assaulting his reputed wife at their Princes Street home on April 9, last.
During the trial on Thursday, the woman, who on April 17 provided the court with a detailed account of how she was beaten, once again took the stand but this time she told the court that her husband did “nothing.”
She said, “On the last occasion I did seh he choked me and lifted me up but now I’m saying he didn’t do nothing.”
The facts which were previously presented by Lance Corporal Jomo Nichols explained that Benjamin who is the father of the woman’s two children reportedly arrived home around 23:00hours that night and proceeded to drag her from the door to the road, cursing her during the assault.
The woman had explained too that the two had an argument there, then she walked back to the house and went inside.
Continuing, she testified that the accused followed her and began to argue some more and then he choked her, lifting her off the ground.
According to her, the children rushed out to see what was happening and begged him to stop hitting their mother. Immediately Benjamin allegedly told the children that they were ungrateful since he “had been minding them all their lives. “
She then ran upstairs and locked herself in her room, but the accused reportedly started banging on the door. The neighbours, she claimed, told her to come out and go to the police which she did.
When Benjamin was first taken before the courts he denied the claims and a trial subsequently got underway before Magistrate Chandan-Edmond.
Following the attempts of the woman on Thursday to recant her evidence in chief, the Prosecution tried to have her deemed a “hostile witness” but the Magistrate who believed that she will be “made a victim twice in such a case,” has involved Red Thread in the matter.
Notwithstanding her attempt to quash the case, the man who is represented by Defence Attorney Paul Fung-a-Fat will still be prosecuted on the charge. The case is set to be called again this week.
Earlier this month, a senior Magistrate recently alluded that the courts will be upping the ante to tackle the issues of gender-based violence stating that the scores of domestic violence victims who often beg pardon for their abusers will no longer be accepted.
Chief Magistrate Priya Sewnarine-Beharry had remarked during a court case that it is no longer an option for victims to “offer no evidence” against alleged perpetrators.
