Supreme Court Judge, William Ramlal is expected to sum up the trial of murder accused, Carl Bennett, on Tuesday.
Bennett, of Lot 148 Cooper Street, Albouystown, is facing a retrial for the murder of Marvin Boston, called “Jess”, on October 24, 2009 in Albouystown.
He appeared before Justice James Bovell Drakes, charged with the murder, last August, but was ordered to face a retrial after the jury failed to reach a verdict in the case.
On October 24, 2009 the accused and his brother allegedly stormed into Boston’s home at King Edward Street, Albouystown, and challenged his cousin to a fight.
Boston went to the aid of his cousin and was stabbed several times about his body. He sustained internal injuries and succumbed while being treated at the Georgetown Public Hospital.
Several witnesses were called upon by State Prosecutors Natasha Backer and Mercedes Thompson to testify in the matter.
Among them was Government pathologist, Dr. Nehaul Singh, the brother of deceased, Nigel Boston and a number of police witnesses.
However, Defence Attorney, Hukumchand Parag, had submitted that there was insufficient evidence before the court to prove that his client is guilty of the murder.
Last Wednesday, Justice Ramlal overruled the lawyer’s no case submission.
