…after Judge overrules lawyer’s no case submission
The retrial of Albouystown resident, Carl Bennett, continued yesterday at the Georgetown Supreme Court, before Justice William Ramlal.
The accused of Lot 148 Cooper Street, Albouystown, is facing a murder charge after he allegedly stabbed Marvin Boston, called “Jess”, on October 24, 2009 in Albouystown.
According to reports, some time around 07:00h that day, the accused and his brother stormed into the Bostons’ home at King Edward Street, Albouystown, and challenged one of the victim’s cousins to a fight.
Boston went to the aid of his cousin and was stabbed several times about his body. He sustained internal injuries and succumbed while being treated at the Georgetown Public Hospital.
Yesterday, the judge overruled a no case submission by Defence Attorney, Huckumchand Parag. The lawyer had submitted that there is insufficient evidence before the court to prove that his client is guilty of the murder.
After the ruling, Bennett was provided with the options of leading his own defence. He opted to give an unsworn statement before the judge and jury.
Standing in the prisoner’s dock, the accused stared at the mixed panel of Jurors and said, “All I want to say is that I am innocent of this offence”.
The Judge then informed the accused that he is entitled to call a witness to his defense.
To this, Bennett replied, “Sir I have spend the last five years behind bars. I don t think that I could come up with witnesses at this point.”
Among the witnesses called upon to testify in the matter by State Prosecutors Natasha Backer and Mercedes Thompson are Government pathologist Dr. Nehaul Singh’; the brother of deceased, Nigel Boston; and several police witnesses.
The trial will continue today.
