The two prosecution star witnesses in the ongoing trial of the two Corentyne men who are accused of murder, failed to show up on Friday when the matter was scheduled to recommence in the Berbice High Court.
On trial for the capital offence before Justice Diana Insanally and a mixed jury are Joshua Persaud called ‘Sunny Boy’ and ‘Bun Boy’, 22 and Raphael Rene Morrison called “Red Head” 24 both of Bloomfield Corentyne, Berbice. The two men are accused of murdering Marlon Andrew Ramcharran on June 3rd 2013 along a street in Block C Tain New Housing Area.
When the matter was adjourned on Tuesday last, following some objections by the defence, led by Senior Counsel Mursalene Bacchus, which triggered some legal arguments, key witness Nicholas Beharry was on the witness stand being led by Prosecutor Renita Singh.
Beharry who was an eyewitness to what occurred had described what happen during the night in question. He was scheduled to continue giving his evidence in chief on Friday and then be subjected to cross examination.
However, he failed to show up and it was later learnt that he was ill.
The other prosecution eyewitness Rakesh Jaikarran, who was with Beharry and was present on Tuesday, also did not show up in court on Friday.
Information is that he cannot be contacted.
So far the prosecution has called a number of witnesses including Detective Assistant Superintendent of Police Gary Mc Alister, who testified to visiting the scene and taking a statement from Morrison.
Detective Constable Emmanuel Rajnauth in his testimony gave evidence that he witnessed Morrison giving his statement. He also visited the scene of the crime and arrested Morrison and testified to finding the cutlass that was allegedly used.
Police Constable Nkofi Austin in his testimony stated that he arrested the number one accused Joshua Persaud at Black Bush Polder. Police Detective Constable Andel Doris who testified to taking photographs of the scene. Two other witnesses also took the stand, including the deceased’s father Surendra Ramcharan who identified the body. The other was Molchan Raghubir who testified that on the night in question, Persaud went by his house in company with Morrison and demanded a cutlass, which he subsequently gave to him. The court had also visited the scene of the crime at Tain on the request of the defence.
The judge has so far ruled that the statements given by the two accused are inadmissible. This was following objections by the defence.
A post mortem examination performed on the body by Dr. Nehal Singh revealed that Ramcharran died from shock and haemorrhage due to multiple incised wounds.
